Charges for the Village of Pulaski service area or discrete portions of the Village service area shall be levied in accordance with formulas and requirements specified in documentation (i.e., map and plan) on which legal formation of said portion of service area was based. A schedule of such charges and other fees applicable under this chapter shall be fixed from time to time by resolution of the Village Board, which schedule shall be made available to the public.
A. 
The Village of Pulaski Clerk-Treasurer shall be appointed by the Village Board to serve as the Billing Clerk and a Collection Clerk. In this role, the Village Clerk-Treasurer shall render bills for sewer use or other service given, and shall collect all accounts due and owing, file a monthly report of accounts with the Village Sewer Board, and make such other reports as the Board may require.
B. 
All money received by the Village Clerk-Treasurer of the Village service area shall forthwith be deposited in such banks or trust companies as the Village Board may from time to time direct.
C. 
Claims and charges against the Village shall be audited and paid in the same manner as Village charges.
All persons discharging wastes to the Village of Pulaski POTW shall pay a sewer rent charge based on a sewer benefit charge, which charge shall be collected as a sewer rent. Sewer rents shall be fixed from time-to-time by resolution of the Village Board, and shall be the source of revenues for retiring debt services, capital expenditures, and operation and maintenance of the Village of Pulaski POTW. Sewer bills shall be rendered quarterly for all POTW customers, payable quarterly on the first day of February; on the first day of May; on the first day of August; and on the first day of November of each year. Bills shall be payable at such times and places as may be designated by the Village Board. The Village Board may provide appropriate penalties for nonpayment of bills, including a shutoff of the water supply.
A. 
In order to equitably compute the amount of sewer rents to be charged to each of the premises connected with and served by the Village POTW, or having property frontage access to a Village of Pulaski sewer collector or street lateral, or any part thereof, the following schedule of chargeable units shall apply:

NOTES:
1 Occupancies which typically have variable or seasonally high wastewater demands (i.e., car washes, restaurants, laundromats, etc.) will be assessed the minimum number of units as specified under the schedule of chargeable units. Units in addition to the minimum may be assessed to reflect excessive wastewater usage, where 18,250 gallons of metered water per quarter increment (200 gpd or 73,000 gallons per year), or portion thereof, will be assessed one unit. The greater of the two unit assessments will be billed.
Example: car wash with 4 bays.
Quarterly metered water consumption: 265,000 gallons/quarter
Minimum quarterly assessment: 4 bays x 3 units = 12 units
Water consumption based assessment: 265,000 gallons/quarter - (12 units x 18,500 gallons/quarter) = 46,000 gallons/quarter overage.
Additional charge, excess water use: 46,000 gallons/18.500 gallons = 2.52 units, considered 3 units by portion thereof.
Total quarterly unit assessment: 12 units + 3 units = 15 units.
2 Unit assessment for industrial users with variable demands and loads will be considered on an individual basis.

B. 
The Village Board of Trustees, upon recommendation of the Sewer Board, shall have the authority to change the benefit based unit structure, rates and charges in accordance with New York State Village Law, and as the interests of the Village may demand.
All users discharging or depositing wastes with concentrations in excess of the pollutant concentrations in normal sewage shall pay a surcharge. The surcharge rate shall be determined based upon the parameter for which the concentration is most in excess of the concentration of normal sewage as a percent above that of normal sewage. The surcharge rate shall be the percentage in excess of that of normal sewage. The surcharge shall be applied to the sewer rent as determined in §  108-152.
A. 
The volume of flow to be used in computing sewer service charges for excessive wastewater users as defined under § 108-152 and/or abnormal sewage surcharges as defined under § 108-153 shall be based upon metered water consumption as shown on the records of meter readings maintained by the Village of Pulaski Water Department or Department of Public Works. In the event that a person discharging wastes into the POTW produces evidence to the Superintendent demonstrating that a substantial portion of the total amount of metered water does not reach the POTW, then the Superintendent shall either establish a percentage of the total metered water to be used as a basis for such computations, or direct the installation of appropriate flow-measuring (and totalizing) devices to measure and record the actual amount of flow into the POTW. In the event that a person discharging wastes into the POTW procures all or part of his water supply from unmetered sources, the Superintendent shall either direct the installation of water meters on the other sources of water supply, or direct the installation of appropriate flow-measuring devices to measure and record the actual amount of flow into the POTW. Any water meters and/or flow-measuring devices installed pursuant to this section shall be of a type and design acceptable to the Superintendent and shall be installed, maintained, and periodically tested as required by the Superintendent, at the owner's expense. All such meters and/or flow-measuring devices shall be subject to periodic inspection, testing, and reading by the Superintendent. Any person discharging wastes into the POTW may install a flow-measuring device at his option, of the type, design, installation, and maintenance standards of the Superintendent, at the owner's expense.
B. 
The Superintendent shall have the right to establish a modification factor, consistent with the typical relationship between water use and sewage discharge, which shall be applied to the volume measured by a sewage flow meter.
The additional charges and fees associated with the operation of the pretreatment program shall be assessed the user, and include:
A. 
Reimbursement of costs of setting up and operating the pretreatment program.
B. 
Issuing permits.
C. 
Monitoring, inspections, and surveillance procedures.
D. 
Costs of equipment and supplies.
E. 
Reviewing accidental discharge procedures.
F. 
Construction inspections.
G. 
Filing appeals.
H. 
Application for consistent removal status as outlined in 40 CFR 403.
I. 
Legal, engineering and/or other consultant costs where required or deemed necessary by the Village.
J. 
Other reasonable expenses to carry out the program to satisfy the requirements of this chapter, the NYSDEC, and the federal government.
The charge for treatment and disposal of trucked or hauled waste which has been introduced into the POTW shall be as established by the Village Board. The manner of determining the volume dumped shall be at the discretion of the Superintendent.
The Village may institute an equitable procedure for recovering the costs of any capital improvements of those parts of the POTW which collect, pump, treat, and dispose of industrial wastewaters from those persons discharging such wastewaters into the POTW.
A. 
Thirty days after due date a late penalty fee of 5% shall be added to the amount of the sewer rent charge, and for each additional month thereafter on the first day of each month an additional penalty fee of 1/2% shall be charged until paid.
B. 
All unpaid, delinquent sewer rent charges shall constitute a lien on the real property served by the Village of Pulaski POTW, and on the first day of May of each year, the Village Clerk-Treasurer shall present to the Board of Trustees, a statement setting forth the amount of each lien for sewer rents in arrears, the real property affected thereby, and the name of the person in whose name the real property is assessed.
C. 
The Board of Trustees shall levy the amounts contained in such a statement against the real property liable at the same time and in the same manner as Village taxes and such amounts shall be set forth in a separate column in the annual tax rolls. The amounts so levied shall be levied and enforced in the same manner and at the same time as may be provided by law for collection and enforcement of Village taxes.
The POTW shall be operated on the basis of a fiscal year commencing on the first day of January and ending on the 31st day of December.
The Village Board shall have the authority to impose fees on new development, which development may:
A. 
Cause enlargement of the service area of the POTW.
B. 
Cause increased hydraulic and/or treatment demands on the POTW.
Revenues derived from capital charges, sewer rents, application or connection fees, user charges and associated penalties, and other fees, shall be credited to a special (sewer) fund. Moneys in this fund shall be used exclusively for the following functions:
A. 
For the payment of the operation and maintenance, including, but not limited to, repair and replacement costs of the Village POTW.
B. 
For the discovery and correction of inflow and infiltration, including storm sewer separation.
C. 
For the payment of interest on and the amortization of or payment of indebtedness which has been or shall be incurred for the extension, enlargement, replacement of, and/or additions to the Village POTW, including any necessary appurtenances.
Any premises upon which a new building is constructed or being constructed, and which is connected to or has parcel frontage access to the Village POTW shall be liable for the sewer rent charge within 120 days from the date of issuance of the building permit or the date of occupancy, whichever occurs first.
A. 
The Village Clerk-Treasurer shall maintain and keep proper books of records and accounts for the POTW, separate from all other records and accounts, in which shall be made full and correct entries of all transactions relating to the POTW. Such records and accounts shall be kept separately for the Village POTW service area, or portions thereof. As necessary, the Village will cause an audit of such books of record and account for the preceding fiscal year to be made by a recognized independent certified public accountant, and will supply such audit report to authorized officials, and the public, on request.
B. 
There shall be an annual review of the sewer charge system to determine if it is adequate to meet expenditures for all programs for the coming year.
C. 
Classification of old and new industrial users should also be reviewed annually.
D. 
The Village shall maintain and carry insurance on all physical properties of the POTW, of the kinds and in the amounts normally carried by public utility companies and municipalities engaged in the operation of sewage disposal systems. All moneys received for losses under any such insurance policies shall be applied solely to the replacement and restoration of the property damaged or destroyed.
