A.
The PUD Planned Unit Development Districts recognize a defined area
for unified and integrated development and to create more flexible
development opportunities than would be possible through the strict
application of other land use and development regulations of this
chapter. Planned Unit Development Districts allow diversification
in the uses permitted and variation in the relationship of uses, structures,
and open spaces and are conceived as cohesive unified projects with
unique standards and regulations. The Planned Unit Development District
shall achieve the following objectives:
(1)
An alternative development pattern in harmony with the objectives
of various Town and regional land use and development plans.
(2)
A creative use of land and related physical development allowing
an orderly transition from one land use to another.
(3)
Diversification in the uses permitted and variation in the relationship
of uses, structures, open spaces and height of structures in developments
conceived as cohesive unified projects.
(4)
Unique standards for site and building design.
(5)
The preservation and enhancement of desirable site characteristics,
such as open space, natural topography, vegetation and geologic features
and the prevention of soil erosion.
The Planned Unit Development District shall be applicable to
any area of the Town of West Bloomfield where the applicant can demonstrate
that the characteristics of the development will satisfy the intent
and objectives of this chapter. Where a planned unit development is
deemed appropriate, the rezoning of land to a Planned Unit Development
District will replace all uses and dimensional specifications contained
elsewhere in this chapter.
A.
All owners of the tract shall be included as joint applicants on
all applications, and all approvals shall bind all owners. A violation
by any owner as to any tract shall be deemed a violation as to all
owners and all tracts.

No PUD District shall be established having an area of less than
five contiguous acres.
A.
The requirements and standards for a Planned Unit Development District
shall be determined for each individual project. At a minimum, the
Planned Unit Development District shall include:

All covenants, deed restrictions, easements and similar restrictions
to be recorded in connection with a Planned Unit Development District
shall provide that they may not be modified, removed or released without
the express consent of the Town Board and shall provide that they
may be enforced by the Town of West Bloomfield in addition to the
landowners within the Planned Unit Development Districts.
C.
Whenever the Comprehensive Plan or Official Map indicates that development
of a Planned Unit Development District will create a need for land
for public parks, playgrounds or other recreational purposes within
the proposed Planned Unit Development District, the Town Board or
Planning Board may require that up to 5% of the total Planned Unit
Development District area be designated and reserved to the Town for
such use. In any such case, if the Town Board or Planning Board determines
that location of such use within the Planned Unit Development District
area is not suitable or practical, it may, in lieu of the aforesaid
designation and reservation of land within the Planned Unit Development
District area, require up to 5% of the current fair market value of
the land within such area to be paid to the Town in the form of cash
as a trust fund to be used by the Town exclusively for neighborhood
parks, playgrounds or other recreational purposes, including the acquisition
of land, available for use by residents of the Planned Unit Development
District.
A.
Incremental development within a PUD District shall be defined as
development occurring wholly within the boundaries of such development
which, while not shown on an approved current plan, complies with
all of the use requirements, space, bulk and yard requirements, parking
and loading requirements.
B.
Except as hereinafter provided with respect to certain support uses, incremental development in any PUD District may be undertaken without amendment of the current plan, subject only to site plan approval in accordance with § 140-150 of this chapter, as hereinafter modified, and issuance of permits and approvals customarily required for the development or establishment of any permitted use.
C.
In addition to required submission materials for site plan approval,
applications for incremental development in a PUD District shall include:
(1)
An analysis, to be submitted to the Code Enforcement Officer, of
the traffic impact for the proposed development, to include:
(a)
Projections of required parking.
(b)
Site-generated and off-site traffic to be expected on streets
in the vicinity upon completion of the proposed development.
(c)
Recommendations for techniques or improvements to deal with
any projected traffic congestion or friction.
(d)
Upon completion of any incremental development, a revised current
plan including the development shall be filed and recorded with the
Town Clerk.
