As used in this article, the term "firearm"
shall include shotguns, air guns, air pistols, spring guns or pistols,
rifles and pistols of any caliber or any implement which impels with
force a pellet of any kind.

Except as herein provided otherwise, it shall
be unlawful and it is hereby prohibited for any person or persons
to fire or discharge any firearm within the Township of Concord, Delaware
County, Pennsylvania.
A.
No person shall, except in defense of person or property
or on an approved target range under adult supervision, fire or discharge
any firearm within the Township of Concord.
B.
Nothing herein contained shall prohibit the use of
a shotgun using scatter shot at any time by anyone otherwise lawfully
permitted to use the same; the use of a shotgun using a rifle slug
during the official Pennsylvania deer season and for deer hunting,
provided that said gun is not discharged within 150 yards of any building;
the use of any type of firearm on an approved target range under adult
supervision; or the use of firearms by any person licensed to carry
such firearms for law enforcement purposes.

C.
No gun
or firearm of any type may be discharged outside the confines of any
building for any purpose within one mile of the edge of any school
zone.

A.
Outdoor target ranges may be permitted subject to
the following regulations:
(1)
A permit for the installation and use of outdoor target
ranges shall be secured from the Township Secretary. Said permit shall
be for a period of one year from the date of issue, and the fee for
such permit shall be $10;
(2)
Said permit may only be issued to the owner of the
premises to be used as an outdoor target range, and said range shall
be for the owner's personal use;
(3)
Said outdoor target range shall have a natural earth
backstop or a backstop of the type and kind approved by the National
Rifle Association;
(4)
No part of said outdoor target range shall be located
within 100 yards of any property line;
(5)
Said outdoor target range may only be used as a target
range during the hours of 10:00 a.m. through 6:00 p.m., prevailing
time, Mondays through Saturdays, inclusive, and shall not be used
on Sundays;
(6)
No person shall discharge on said outdoor target range
at any time any firearm having a caliber in excess of a .22 caliber;
and
(7)
A target range located wholly within a residence or
a building used on a lot in connection with a residence may be used
in accordance with the terms of this article without securing a permit.
B.
Any police officer lawfully engaged in his law enforcement
duties within the Township of Concord is hereby authorized to seize
and confiscate any firearm, as defined herein, which shall be fired
or discharged within the limits of the Township of Concord in violation
of this article.

A.
Any person who shall violate any provision of this
article or who permits the violation of any provision of this article
shall pay a fine of $600.
B.
Each violation for each separate day and each violation
of any provision of this article shall constitute a separate and distinct
violation.
C.
Any person who violates or permits the violation of
any provision of this article shall, upon being found liable therefor
in a civil enforcement proceeding commenced by Concord Township, pay
the fine prescribed by this article, plus all court costs, including
reasonable attorney fees, incurred by Concord Township.

The provisions of this article shall not apply
to the use of bows and arrows in schools and clubs under competent
adult supervision. Nor shall this article prohibit the use of bows
and arrows in accordance with the Game and Wildlife Code, Act 93 of
July 8, 1986, P.L.442 (34 Pa.C.S.A. § 101 et seq.).
The following words, when used in this article,
shall have the meanings given to them in this section, unless the
context clearly indicates otherwise:
A missile shot from a bow, having a slender shaft with fletching
or vanes at the butt and a pointed head.
A weapon which propels an arrow, is hand-held, hand-drawn,
held in the drawn position by hand or by a hand-held mechanical device
and released by hand.
The Board of Supervisors or its designee is
authorized to issue permits for outdoor target ranges after the inspection
and approval of such ranges. Outdoor target ranges may be permitted
subject to the following regulations:
A.
A permit for the installation and use of outdoor target
ranges shall be secured from the Township Secretary. Said permit shall
be for a period of one year from the date of issue, and the fee for
such permit shall be $10;
B.
Said permit may only be issued to the owner of the
premises to be used as an outdoor target range, including owners of
two or more adjoining premises applying for a range for their joint
use, and said range shall be for the permittee's personal use;
C.
Said outdoor target range shall have a natural earth
or artificial backstop so that the arrow cannot travel more than 15
yards beyond the target aimed at, after making due allowance for deflection
in any direction not to exceed an angle of 45°, or a backstop
of the type and kind approved by the National Rifle Association;
D.
No part of said outdoor target range shall be located
within 150 feet of the property line of the permittee, and the range
shall be so constructed and located that no arrow can travel within
150 feet of the property line of the permittee (such property line
being defined as the outside property perimeter of two or more adjoining
premises where a joint permit has been issued);
E.
Said outdoor target range may only be used as a target
range daily during the daylight hours between 10:00 a.m. and 6:00
p.m., prevailing time; and
F.
A target range located wholly within a residence or
a building used on a lot in connection with a residence may be used
in accordance with the terms of this article without securing a permit.
Bow hunting shall be permitted within the Township
only as conducted according to the Pennsylvania Game and Wildlife
Code,[1] except that no such hunting shall be permitted within
150 feet of a property line or in a manner which could cause an arrow
to pass within 150 feet of a property line.
