A. 
Approved consumer waste and recyclable materials collection containers shall be placed at the curb line by 6:00 a.m. on the scheduled day of collection, but shall not be placed at the curb line prior to 12:00 noon of the day prior to collection day, and shall be removed from the curb line not later than 12:00 noon of the day after collection day. Failure to comply shall be a violation and may result in the issuance of a citation.
B. 
Only consumer waste and recyclable materials generated in the City of Montello may be placed in the containers for pickup. Violations may result in the issuance of a citation.
C. 
The City of Montello and its contracted waste hauler will supply one consumer waste container, and one recyclable material container per each residential or small business parcel. If refuse is in excess of the supplied containers, it is the parcel owner's responsibility to find another means of garbage disposal.
D. 
Except as otherwise provided, any person who shall violate any provision of this chapter or any order, rule, or regulation made under this chapter shall be subject to a penalty, except that any forfeitures imposed shall be consistent with the forfeitures under §§ 287.95 and 287.97, Wis. Stats., where applicable. Specific penalties for violations may be assessed as follows:
(1) 
Any person who violates may be required to forfeit $10 for a first violation, $50 for a second violation, and not more than $100 for a third or subsequent violation.
E. 
The contracted waste hauler may refuse to furnish city collection service of post-consumer waste or recyclable materials to any person not complying, or refusing to comply, with these articles, and the rules and regulations made by the contracted waste hauler for the collection and disposal of solid waste.
F. 
When services of the city's collection of solid waste have been withdrawn from any person for failure to comply with such rules and regulations, resulting in an accumulation of solid waste on said persons premises which is offensive or a public nuisance, that person may be prosecuted under any city ordinances regulating the same.

Commencing May 29, 1992, all residents of the City of Montello shall cooperate in the recycling of garbage and refuse by performing the following:
A. 
All recyclable material shall be separated from other garbage and refuse and placed in the supplied recyclable material container on the scheduled pick up day. Placement must comply with § 286-1A.
B. 
All other nonrecyclable refuse shall be placed in the provided consumer waste container for collection. Placement of container must comply with § 286-1A.
C. 
Recyclable materials may also be taken to the City of Montello Recycling Center during its normal hours of operation. Fees may apply.
D. 
Any garbage or refuse not placed for collection in accordance with the provisions of this section may be refused by the contracted collector.
E. 
Penalties for violation of any provision of this section are per § 286-1D.

In the event of a City-funded or City-sponsored large item trash or rubbish pickup, it shall be the responsibility of the property owner or tenant to remove any and all trash or rubbish remaining on the property after the City's solid waste contractor has completed their trash and rubbish pickup. Remaining trash and rubbish shall be removed within 24 hours after completion of the large item trash pickup, or said trash and rubbish will be removed by the City or its contractor, and all labor charges and related costs for said removal shall be added to the property owner's tax bill.
