The town will not be responsible for any rehabilitation costs.
Upon receipt of a positive test result for drugs and/or alcohol, if an employee undergoes rehabilitation as recommended by the substance abuse professional (SAP) and is eligible for Workers' Compensation or New York State Disability, the employee would be eligible for statutory benefits only. Upon completion of the rehabilitation program, the employee must submit to a return-to-duty test with a verified negative result and be released to full duties. The employee in the above situation will not be eligible for any other town benefit (e.g., long-term disability, catastrophic illness, sick leave, personal service time, etc.).
Once an employee has received rehabilitation and/or tests positive a second time, the town will take appropriate measures and/or seek discipline up to and including termination.
If the substance abuse professional (SAP) recommends that an employee undergoes rehabilitation and the employee refuses, the town will prepare charges pursuant to § 75 of the Civil Service Law and seek discipline up to and including termination.
