The purpose of this chapter is to establish the Department of Fire Prevention
and Investigation as a separate department of the town government in the Town
of Guilderland.
A.
The head of the Department of Fire Prevention and Investigation
shall be called the "Chief Fire Inspector and Investigator" and shall be appointed
by and serve at the pleasure of the Town Board of the Town of Guilderland,
and his salary shall be fixed by the Town Board from time to time.
B.
The Chief Fire Inspector and Investigator shall supervise
such other assistant fire inspectors as the Town Board may provide for in
the town budget.
A.
It shall be the duty of the Chief Fire Inspector and
Investigator to administer and enforce the New York State Uniform Fire Prevention
and Building Code, as well as any local laws enacted by the Town of Guilderland,
including L.L. No. 2-1966, entitled the "Fire Law,"; L.L. No. 4-1966[1] regarding agreement with fire districts; Chapter 171, Fire Prevention and Building Construction, Article II, as amended; and any other law in connection with fire investigation and inspection.

B.
It shall be the duty of the Chief Fire Inspector and
Investigator to work with, render advice to and consult with other town departments,
including but not limited to the Police Department, Emergency Medical Services,
Building Department and Code Enforcement Bureau regarding fire inspections
and investigations.
C.
It shall be the duty of the Chief Fire Inspector and
Investigator to report to the Town Board on an annual basis regarding the
operations of his Department and the status of fire inspection and investigation
in the town, and on a regular basis, as requested, to the Town Supervisor
regarding the operations of the Department.
D.
It shall be the duty of the Chief Fire Inspector and Investigator to report to the Supervisor on a monthly basis regarding any imposition of fines or penalties as set forth in § 171-11 of Chapter 171, Fire Prevention and Building Construction, Article II, as amended, of the Town of Guilderland; and to include also in such report the number of fire inspections undertaken during the month and the fees collected in connection therewith.
E.
It shall be the duty of the Chief Fire Inspector and Investigator to advise the Board of Review for Building Conservation and Fire Prevention, as established under and included in Chapter 171, Fire Prevention and Building Construction, Article III, on issues involving fire inspection in any matter involving the New York State Uniform Fire Prevention and Building Code.
F.
It shall be the duty of the Chief Fire Inspector and
Investigator to serve as the liaison to fire departments and fire districts
serving the residents of the Town of Guilderland, and to report to the Town
Board and the Town Supervisor regarding the concerns expressed by said departments
and districts.
In order to support the Fire Prevention and Investigation Department,
as well as the Building Department, the Town Board does establish a fee schedule[1] to apply to such fire inspections and building inspections of
nonresidential properties as are required under the New York State Uniform
Fire Prevention and Building Code. Said fees shall be set by the Town Board
upon adoption of this chapter, and amended by Town Board resolution as needed.
