There is hereby established a Parks and Recreation Department for the Village of Hastings-on-Hudson.
There is hereby established a Parks and Recreation Commission for the Village of Hastings-on-Hudson.
The Recreation Commission of the Village of Hastings-on-Hudson as presently constituted is hereby abolished.
As used herein, the following terms shall have the meanings indicated:
PARK or PARKS
Includes all dedicated public parks, playgrounds, athletic fields, recreation centers, open spaces and other areas used for park and recreation purposes, beautification projects, including all buildings, structures, equipment and appurtenances, as well as entrances and approaches thereto, and roads and parking places located in such park or parks, and such other rights and appurtenances as the Village may have or utilize for such park purposes, whether the same be under the care and control of the Village by lease or otherwise, provided only that the same be used for park and recreation purposes or either of such purposes.
RECREATION
Refers to leisure activities voluntarily engaged in by residents of the Village of Hastings-on-Hudson, which are offered under the auspices of the Parks and Recreation Department.
A. 
Appointment. The Parks and Recreation Department shall be administered by a Superintendent of Parks and Recreation, who shall be appointed by and be responsible to the Village Manager. The Village Manager shall make such appointment after consultation with the Parks and Recreation Commission. He shall be appointed in the manner provided by the Civil Service Law of the State of New York from a list of eligible candidates determined by a competitive test.
B. 
Duties. The Superintendent of Parks and Recreation shall be the administrative head of the Department of Parks and Recreation. He shall perform the duties required of him in accordance with policies established by the Parks and Recreation Commission and under the administrative supervision of the Village Manager, and he shall be subject to all the laws, controls, procedures, rules and regulations applicable to other Village departments. The Superintendent of Parks and Recreation shall attend all regular and special meetings of the Commission and may participate fully in all discussions. He shall have no vote on said Commission. The Superintendent shall, upon consultation with and the approval of the Village Manager, and within budgetary limitations, employ all other persons as he shall deem necessary and proper to carry out the policies established by the Parks and Recreation Commission.
The provisions of § 209-9A requiring appointment under the Civil Service laws shall not apply to any person employed by the Recreation Commission as of the effective date of this article.
The Department shall operate and maintain all of the parks and recreation services and facilities assigned to it from time to time by the Village Board of Trustees. Said operation and maintenance shall be governed by the policies established by the Parks and Recreation Commission. The Village Manager, subject to the approval of the Board of Trustees, may transfer related administrative functions to the Parks and Recreation Department, or from the Parks and Recreation Department to other Village departments or offices, when, in his judgment, such transfer is necessary and proper.
A. 
Appointment and organization. The Parks and Recreation Commission shall consist of seven members who shall be residents of the Village. Six of such members shall be appointed by the Village Manager with the advice and consent of the Mayor and Board of Trustees. The seventh member shall be jointly designated by the Village Manager and by the Board of Education of Union Free School District No. 4.

B. 
Term of office. The members of this Commission shall serve for a term of three years, each term to expire at the end of the Village's official year. Except that of those first appointed, three shall be chosen from the present Recreation Commission and shall serve a term of two years each on the new Parks and Recreation Commission; two additional members shall be chosen from the present Recreation Commission and shall serve a term of one year each; the member jointly designated by the Village Manager and the Board of Education and the member appointed from the Conservation Commission will each serve a term of three years. Thereafter, their successors shall be appointed for the term of three years from and after the expiration of the terms of their predecessors in office.
C. 
Compensation. The members of the Parks and Recreation Commission shall serve without compensation, but shall be entitled to reimbursement for any expenditures authorized in the performance of their duties.
D. 
Officers. The members of the Commission shall annually elect, from its own members, a Chairman and Vice Chairman.
E. 
Vacancies. Any vacancy on the Commission shall be filled for the unexpired term in the same manner in which the original appointment was made.

F. 
Powers, duties and responsibilities.
(1) 
The Commission shall be responsible for the making of policies which govern the regulation and use of all Village parks, recreation programs and related facilities.
(2) 
The Commission shall ascertain and evaluate the recreation needs of all Village residents, and recommend to the Superintendent of Parks and Recreation, from time to time, the establishment, operation and expansion or retrenchment of parks and recreation services with respect to these needs.
(3) 
The Commission shall develop and recommend to the Mayor and Board of Trustees plans for future park and recreation programs and facilities, capital projects and improvements.
(4) 
The Commission shall make recommendations with respect to the budget for operations and capital projects submitted to it by the Superintendent and approve the budget prior to his submission of such budget to the Village Manager.
(5) 
The Commission shall recommend long-range plans to the Board of Trustees, and also recommend operating policies and regulations for the Department, for the protection, conservation and enhancement of the natural plant life, wildlife, brooks, ponds and other water resources, soils and scenic beauty of Village park lands.
(6) 
The Commission shall advise on matters having to do with the regulation and use of the parks and recreation facilities and submit to the Mayor and Board of Trustees, for its consideration, resolutions or ordinances regulating the use of such facilities and fixing the fees and charges to be paid for the use of any such facilities.
(7) 
The Commission may appoint such committees from time to time as it may deem necessary.
G. 
Meetings. The Commission shall regularly meet once each month at a time and place set by said Commission for its regular meeting, and such meeting shall be open to the public. A quorum shall consist of four members. The Chairman or any three members of the Commission may call a special meeting of said Commission for such purposes as are designated in said call. Notice of said meeting shall be given, in writing, to all members and to the Superintendent of Parks and Recreation 72 hours in advance of said special meeting. The Village Clerk shall be responsible for giving notice of all regular and special meetings of the Parks and Recreation Commission.
