A. 
A Board of Examiners shall be appointed by the Board of Trustees of the Village of Hastings-on-Hudson, who shall examine and determine the competency and fitness of applicants for licenses to engage in the business of plumbing or employing plumbers in the Village of Hastings-on-Hudson, and shall report their findings to the Board of Trustees of said village.
B. 
The Board of Examiners shall consist of five members, composed of three master plumbers, one journeyman plumber and the Plumbing Inspector of the Village of Hastings-on-Hudson.
The Examining Board of Plumbers shall hold office as follows: the three master plumbers and one journeyman plumber shall serve for a period of three years and the Plumbing Inspector shall serve as a permanent member of the Board. At the expiration of their terms, appointments will be made for a full term by the Board of Trustees.
Vacancies by death, removal, inability to act, resignation or removal from the village of any member shall be filled by the Board of Trustees for the unexpired term. In the event of the term of office or removal of the Plumbing Inspector, appointed by said Board of Trustees, expiring during the duration of appointment to serve on the Examining Board of Plumbers, his successor shall act in his stead.
The compensation for the services of the master and journeymen plumbers of the Examining Board shall be $5 for each member of the Examining Board present at the examination. Only the members present at the examination shall be recompensed. No examination shall be held except in the presence of at least three members of the Examining Board. Examination shall be given within 30 days from date of application.
All members of the Examining Board shall be citizens and actual residents of the Village of Hastings-on-Hudson.
The powers and duties of the Examining Board are as follows:
A. 
To meet at stated intervals. They shall also meet whenever the Board of Trustees or the Mayor shall, in writing, request them to do so.
B. 
Three members of the Examining Board shall constitute a quorum.
C. 
To have jurisdiction over and to examine all persons desiring or intending to engage in the trade, business or calling of plumbing and employing plumbers in the Village of Hastings-on-Hudson.
D. 
To have powers of examining persons applying for licenses or certificates of competency.
E. 
To determine their fitness and qualifications for conducting the business of employment of master plumbers.
F. 
To recommend the issuing of licenses or certificates of competency to all such persons who shall have passed a satisfactory examination before such Board.
G. 
Shall be by it determined to be qualified for conducting the business of employment of master plumbers.
H. 
To formulate, in conjunction with the Board of Trustees of the Village of Hastings-on-Hudson, a code of rules and regulations for the work of plumbing and drainage and venting; also oil-burner and gas-burner and fitting installations in such village, including the materials, workmanship and manner of executing such work, and from time to time to add to, amend or alter the same, or, in its discretion, to adopt the Standard Plumbing Code recommended by the State Department of Health.
A. 
No person otherwise qualified shall engage in the trade, business or calling of a plumber, or of plumbing, gas-burner installation or gas-fitting installations, in said village as employing or master plumber until he has first procured from the Village of Hastings-on-Hudson and the Examining Board of Plumbers of said village, so designated by local law in such village, a metal plate sign or a certificate certifying that he has complied with all requirements as provided herein. Such plate, sign or certificate is to be conspicuously posted in place of business where such business is conducted.
B. 
Any person retiring, abandoning or not actually engaged in such trade, business or calling, hereinbefore mentioned, shall surrender to the Village of Hastings-on-Hudson such plate, sign or certificate, and shall not again engage in such trade, business or calling until he has again procured a plate, sign or certificate as hereinbefore provided.
C. 
Any person to whom a license or certificate to do plumbing in the Village of Hastings-on-Hudson has been issued, who shall loan, rent, sell or transfer the same to anyone other than to whom it has been issued, will be subject to a fine not exceeding $100 and shall have his license or certificate suspended.
A. 
Any willful violation of the provisions of this regulation or article shall constitute disorderly conduct.
B. 
Such license or certificate of competency may be canceled by the Examining Board of Plumbers of the Village of Hastings-on-Hudson, duly appointed, and enforced therein, after a hearing had before said Examining Board of Plumbers, and upon a prior notice of not less than 10 days, stating the ground of complaint, and served on the person charged with the violation; but such revocation shall not be operative unless concurred in by the majority of the Board of Examiners present.
C. 
All licenses or certificates of competency issued under the provisions of this article and all licenses authorizing connections with a water main or mains or street sewers shall expire the 31st day of December of the year in which they shall be issued and may be renewed within 30 days preceding such expiration, such renewals to be for one year from the first day of January in each year; renewal bond and filing fee to be determined by the Village Board by resolution and set in the fee schedule.[1]

D. 
Insurance.
(1) 
In addition to providing and filing the surety (Plumbers' Board) bond herein required, no plumber licensed under and pursuant to the provisions of this article shall engage in any plumbing business or work within the Village of Hastings-on-Hudson unless there is on file in the office of the Building Inspector a current certificate of insurance in form satisfactory to the Building Inspector evidencing that the plumber is carrying in full force and effect a contractor's protective liability policy of insurance or such other insurance as will provide that an insurance company licensed to do business within the State of New York will pay on behalf of the plumber all sums which the plumber shall become legally obligated to pay as damages to persons or property because of any act or omission of the plumber, or any other person for whose acts or omissions the plumber is legally responsible arising out of performance of plumbing services for others by the plumber. Said insurance policy shall be in the minimum amount of $20,000 to cover any and all claims arising or resulting from any one service performed by the plumber.
(2) 
Any certificate of insurance or renewal thereof shall be filed annually in the office of the Building Inspector in January of each year, commencing on January 1 of each year.
A. 
All licensed master and employing plumbers shall be held responsible for all acts of their apprentices or employees in connection with the business for which such licenses are given. Any person violating any of the provisions of this article may be liable to a fine not exceeding $100 for each offense, and, if the person offending shall be a licensed plumber, may have his license suspended.
B. 
Any person doing plumbing work as a trade or calling for compensation without a license or certificate of competency being issued thereto shall be guilty of disorderly conduct. This provision does not apply to such plumbing work as performed and inspected under State Factory Laws; neither is it intended to apply to such persons making replacements to parts of fixtures, such as washers, not requiring inspection, and where no compensation is made.
A. 
In the event that the Village Plumbing Inspector shall be engaged in doing the business of plumbing, and has complied with all of the requirements of this article, any work performed by said Inspector shall be inspected by two members designated by the Board of Examining Plumbers.
B. 
A fee for such inspection shall be paid and divided equally between the two members making inspection.
C. 
Fees are to be as provided in the Plumbing Code[1] under the heading "Fees for Inspection."

The expense of examination for license or certificate of competency shall be and is hereby to be determined by the Village Board by resolution and set in the fee schedule,[2] which shall be paid to the Village of Hastings-on-Hudson by the applicant, in advance.

B. 
If the application is denied for failure to pass the required test, the applicant shall receive a refund of only an amount to be determined by the Village Board by resolution and set in the fee schedule on his deposit, the balance to be retained by the Village of Hastings-on-Hudson to cover expenses of the Board of Examining Plumbers, the balance to the Village Treasury. All moneys so collected shall be paid to the Village of Hastings-on-Hudson.

A. 
A plumber holding a license or certificate of competency showing that he has passed a test for plumbers in the State of New York may not be required to subject himself to a test, but must present such license or certificate to the Examining Board of Plumbers for its certification; but the fee to be determined by the Village Board by resolution and set in the fee schedule must be paid in any event.[1]

B. 
When no examination test is held, no compensation will be paid to the Examining Board, but the entire fee shall be paid to the Village of Hastings-on-Hudson.
A. 
Plumbers who have filed their bond with the Village of Hastings-on-Hudson, and whose name appears on the list on file in said Village Clerk's office as of the date of May 5, 1936, may be extended the privilege of presenting themselves to the Examining Board of Plumbers for examination and test without payment of the fee to be determined by the Village Board by resolution and set in the fee schedule,[1] provided that he has signed, in writing, within 30 days of notice, his willingness to present himself for examination and test on a date set by the Examining Board of Plumbers.[2]

B. 
Failure to avail himself of this opportunity will disqualify him from this exemption.
C. 
When no registration fee is paid as covered by the preceding section, no compensation will be paid to the Examining Board of Plumbers.
A. 
The license fee to be determined by the Village Board by resolution and set in the fee schedule need only be paid once during the existence of the business of the individual actively engaged in the business, but, in addition thereto, a surety bond, plus a fee for the filing of the bond, in an amount to be determined by the Village Board by resolution and set in the fee schedule shall be filed and paid each year to the Village Clerk of Hastings-on-Hudson, after recommendation from the Board of Examining Plumbers to the Board of Trustees that a license or certificate of competency be issued, and the surety bond being satisfactory to and approved by the Board of Trustees of Hastings-on-Hudson.[1]

B. 
No license or certificate of competency, except as hereinbefore provided, shall be issued until:
(1) 
Payment of a fee to be determined by the Village Board by resolution and set in the fee schedule.[2]

(2) 
Passing an examination by the Board of Examining Plumbers.
(3) 
Furnishing of a bond for one year in an amount to be determined by the Village Board by resolution and set in the fee schedule, and a certificate of insurance for $20,000.[3]

C. 
All bonds and certificates of insurance shall be for one year, beginning on the first day of January and expiring on the 31st day of December of the current year.
D. 
Should a plumber fail to file a bond and certificate of insurance on the first day of January, but elects to do so during the current year, the term of the bond shall be for the remainder of that year.
E. 
For failure to file a bond and certificate of insurance during any one year or longer period, the applicant's license or certificate of competency will be voided until such time as the applicant requests, in writing, accompanied by the required fee to be determined by the Village Board by resolution and set in the fee schedule, to reinstate his plumber's license within the Village of Hastings-on-Hudson.[6]

F. 
Applicants having complied with the foregoing requirements and licenses or certificates issued must comply with all rules and regulations prescribed in the Plumbing Code.[7]

The State Building Construction Code applicable to plumbing became effective in the Village of Hastings-on-Hudson upon its promulgation 2-15-1958.]
