The parking of oversized commercial vehicles, trailers, and containers, including PODS® or dumpsters, on Village streets and in Village parking lots is to be prohibited. Such parking takes away necessary parking spots for Village residents, visitors and noncommercial vehicles and causes excess wear and tear on streets and parking lots.
As used in this article, the following terms shall have the meanings indicated:
BUSINESS OFFICE VEHICLE OR TRAILER
Any vehicle or trailer used to conduct business with customers or other individuals from within or without the vehicle or trailer while parked anywhere in the Village of Haverstraw.
COMMERCIAL VEHICLE
Any vehicle which is used to conduct business and fits within the confines of the Village's standard parking space.
OVERSIZED COMMERCIAL VEHICLE, TRAILER, CONTAINER OR DUMPSTER
Any used in conducting business which does not fit within the confines of the Village's standard size parking space of nine feet by 20 feet.
The following activities shall be illegal in the Village of Haverstraw.
A. 
The parking or storing of any oversized vehicle on the street or in the parking lots of the Village of Haverstraw. This prohibition shall not apply while said vehicles are actively loading or unloading material or other goods associated with the business owning or operating the vehicle.
B. 
Commercial vehicles may not be parked on the Village streets for more than 1/2 hour, except when actively loading or unloading materials and other goods associated with the owner or operator of the vehicle's business.
C. 
The placing of temporary storage containers (commonly known as PODS® on private property for more than 60 days.
A. 
All oversized commercial and commercial business vehicles set forth in § 160-2 above shall first use all available loading zones for picking up and delivering goods and materials.
B. 
In the event a loading zone is not available, commercial and business vehicles may use parking spaces for dropoff and deliveries for a period of no more than two hours. These vehicles shall pay all parking fees for the spot or spaces they take up in whole or in part.
The Village Board may, by resolution, designate areas where all vehicles set forth in § 160-2 may be permitted to park or be stored and create rules and regulations for such parking or storing, including appropriate fees for permits.
All garbage and other dumpsters or storage containers used or located in the Village of Haverstraw shall obtain a permit from the Village Clerk after completing an application setting forth the use, size, location, times of use and loading and unloading as well as the name, address and phone number of the individual owner and company responsible for the operation of the dumpster or container and the individual or entity using the dumpster.
The Board of Trustees may, by resolution, create rules and regulations concerning the use and operation of all dumpsters and containers in the Village of Haverstraw as well as set permit fees.
The individual or entity owning or operating any dumpster or storage container in the Village of Haverstraw shall be responsible for keeping the dumpster/container and the surrounding area in a clean, sanitary and safe condition. The dumpster lid or storage container door shall be kept closed at all times. Dumpsters shall be maintained free of rodents, and insects, particularly flies and maggots. Garbage dumpsters shall be emptied and sanitized on a regular basis. Dumpsters/containers shall be kept only within the areas specified in their permits and shall not block any areas which are traversed by vehicular or pedestrian traffic.

Any violation of this article shall be punished by a fine of up to $500, as well as the suspension or revocation of the permit or parking privilege involved; and which charge, under this article, shall be a petty offense or infraction, and not a crime. The continuation or repeat of a violation of, or failure to comply with, any provision of this article shall constitute, for each occurrence that transpires or each day on which the violation continues, a separate and distinct charge hereunder.
This ordinance may be enforced by town police officers, village building inspectors, code enforcers and parking attendants.
All suspensions or revocations of parking privileges or permits pursuant to this article shall be by determination of the Building Inspector or the Village Clerk. Any individual or other entity subject to a suspension or revocation, pursuant to this article, shall have the right to appeal such suspension or revocation to the Zoning Board of Appeals by serving said appeal, in writing, to the Clerk of the Zoning Board within 30 days of the date of the revocation and/or suspension and the receipt of same, and the applicant shall receive a hearing before the Zoning Board of Appeals pursuant to the procedures set forth in the Village Law of the State of New York, § 7-712-a.
