As used in this article, the following terms shall have the meanings
indicated:
All Town owned and maintained boardwalks running along the northerly
shoreline of Fifth Lake Outlet, and the dock area extending from the shoreline
into the waters of Fourth Lake at the Arrowhead Property owned by the Town
of Inlet.
The person actually holding title to a vessel.
An individual, partnership, corporation or association.
Any floating craft as defined in § 2 of the Navigation
Law of the State of New York and for the purposes of this article shall also
include row boats, canoes, and personal watercraft.
A.
All persons are prohibited from parking, placing, mooring,
or leaving a vessel at the section of the Town of Inlet boardwalk starting
from the easterly end of the South Shore Road Bridge stairway and extending
in a westerly direction along the northerly shore of the Fifth Lake Outlet
220 feet for periods longer than four hours between the hours of 8:00 a.m.
and 12:00 midnight from June 15 to September 15 of each year.
B.
Nor shall any owner permit his vessel to be parked, placed,
moored, or left at the section of the Town of Inlet boardwalk starting from
the easterly end of the South Shore Road Bridge stairway and extending in
a westerly direction along the northerly shore of the Fifth Lake Outlet 220
feet for periods longer than four hours between the hours of 8:00 a.m. and
12:00 midnight from June 15 to September 15 each year.
All landowners with real property fronting on said boardwalks along
the Fifth Lake Outlet shall be exempt from this article.
The Supervisor of the Town of Inlet shall obtain and erect appropriate
signs adequately advising the public of the parking regulations set forth
herein.
All persons using the Town of Inlet's boardwalks and dock areas
do so at their own risk, and the Town of Inlet accepts no liability for any
damage, loss, or theft of vessels, equipment, or contents thereof arising
out of the use of said Town of Inlet boardwalks and docks areas.
A.
A violation of this article is hereby declared to be
an offense, and any person or owner violating the same shall, upon conviction,
be punished by a fine of not less than $25 nor more than $250, or by imprisonment
not to exceed 10 days, or by both such fine and imprisonment.
B.
Any vessel remaining parked, placed, moored, or left at the portion of the Town of Inlet boardwalk described in § 70-2 above, for a period of more than 24 consecutive hours during the period of June 15 to September 15 of each year may be removed by the Town of Inlet, and the owner of such vessel shall be obligated to pay the towing and storage charges in addition to any penalty imposed by this article.

The purpose of this article is to promote the health, safety and general
welfare of the community, including the protection and preservation of the
shoreline properties on Fifth Lake of the Fulton Chain of Lakes, in the Town
of Inlet, Hamilton County, New York, by establishing regulations governing
the wake and speed of vessels operated on Fifth Lake. The intent is to prohibit
vessels on Fifth Lake from being operated in a manner which causes an unreasonable
wake or at a speed in excess of five miles per hour.
For the purposes of this article, the following words, terms and phrases
shall have the meaning ascribed to them in this section:
An individual who operates or navigates a vessel.
A person actually holding title to a vessel.
An individual, partnership, corporation or association.
Any floating craft and shall include public vessel, residential vessel,
pleasure vessel, personal watercraft and specialty prop craft, all as defined
by the Navigation Law of the State of New York.
A.
No owner shall permit his or her vessel to be operated
on Fifth Lake of the Fulton Chain of Lakes, in the Town of Inlet, Hamilton
County, New York, in a manner or at a speed that causes a wake that unreasonably
interferes with or endangers the shoreline, docks or other vessels, and in
no event at a speed exceeding five miles per hour within 1,500 feet of the
shoreline at low water mark of Fifth Lake.
B.
No vessel shall be operated on Fifth Lake of the Fulton
Chain of Lakes, in the Town of Inlet, Hamilton County, New York, in a manner
or at such a speed that causes a wake that unreasonably interferes with or
endangers the shoreline, docks or other vessels, and in no event at a speed
exceeding five miles per hour within 1,500 feet of the shoreline at low water
mark of Fifth Lake.
The Town Board of the Town of Inlet shall cause a sign to be conspicuously
placed, notifying owners and operators of vessels that Fifth Lake is a "Vessel
Regulation Zone" and that vessels may not be operated in a manner to cause
an unreasonable wake, and in no event in excess of five miles per hour on
Fifth Lake.
A.
Any person who violates any provisions of this article
shall be guilty of a violation.
B.
Every person convicted of a first violation of this article
shall be punished by a fine of not less than $25, nor more than $100, or by
imprisonment for not more than seven days, or by both such fine and imprisonment.
C.
Every person convicted of a second violation of this
article and committed within a twenty-four-month period shall be punished
by a fine of not less than $100, nor more than $250, or by imprisonment for
not more than 15 days, or by both such fine and imprisonment.
D.
Conviction for a third or subsequent violation, all of
which were committed within a period of 24 months, shall be punished by a
fine of not less than $250, nor more than $550, or by imprisonment for not
more than 30 days, or by both such fine and imprisonment.
