A.
The Board of Trustees of the Village of Islandia hereby
determines and finds that the Village of Islandia is a unique place in Suffolk
County and the State of New York due to its geographic location, manner of
development and the aesthetic qualities of the Village.
B.
The Board of Trustees finds that the Village of Islandia
contains areas of commercial, corporate, hotel, and other types of nonresidential
development that is either adjacent to or developed within areas of desirable
residential development and that the Village of Islandia remains a desirable
place for living, working and business due to the balancing of the concerns
and interests of the residential and nonresidential interests of the community
and the existence of those communities without a substantial interference
with the quality of life of the residential communities in the Village by
the nonresidential communities.
C.
The Board of Trustees finds that heliports or the landing
of helicopters in the Village would be a substantial detriment to the quality
of life of the residents of the Village and would create a substantial disturbance
in the residential and nonresidential communities of the Village and for that
reason the Board of Trustees should adopt this chapter.
Heliports and helicopter landing areas are hereby prohibited in the
Village of Islandia. The maintaining, design or use of any place or property
in the Village of Islandia as a heliport or for the landing of helicopters
is hereby prohibited.
It shall be a violation of this chapter for any party or entity to create,
design, maintain or use any property or place in the Village of Islandia for
a heliport or otherwise for the landing of helicopters. Each day that a violation
of this chapter exists shall constitute a separate violation of this chapter.
The penalty for each violation of this chapter shall be $250 or such
other amount as a court of competent jurisdiction may assess.
The election by the Village of Islandia of a form of remedy in the enforcement
of this chapter shall not constitute a waiver by the Village of any other
form of remedy, and the Village may seek injunctive or other relief to obtain
compliance prior to or after assessing fines or penalties.
In the event that any section or portion of this chapter shall be deemed
to be unenforceable or of no effect, the remainder of the chapter shall survive
and remain in full force and effect.
