By the authority of the local law adopted by the Village Board on the 27th day of March, 1995, pursuant to the provisions of Article 7 of the Village Law, the Village of Islandia Planning Board shall have the power and authority to approve, approve with modification or disapprove plats for subdivision within the incorporated area of the Village of Islandia.
In order that land in the Village of Islandia may be subdivided in accordance with the policy set forth herein, the regulations are hereby adopted and shall be known and may be cited as the "Village of Islandia Subdivision Regulations."
A. 
The following are regulations for the subdivision of land for various purposes as adopted by the Village of Islandia Village Board on March 27, 1995. These regulations are promulgated to control and provide for the orderly growth and coordinated development of the Village of Islandia consistent with its fiscal and infra structural limitations to assure the comfort, convenience, health, safety and welfare of its citizens in accordance with the Constitution of the State of New York. This means, among other things, that:
(1) 
Land to be subdivided and developed shall be of such character that it can be used safely for building purposes without danger to health or peril from fire, flood or other menace.
(2) 
Proper provision shall be made for drainage, water supply, sewerage and other needed improvements.
(3) 
All proposed lots shall be so laid out and of such size as to be in harmony with the development pattern of the neighboring properties.
(4) 
Proper consideration shall be given to the protection of the environment and local ecology.
(5) 
The proposed streets shall compose a convenient, orderly and safe network and shall conform to the Official Map of the Village and shall be properly related to the Comprehensive Plan and shall be of such width, grade and location as to accommodate the prospective traffic, to facilitate fire protection and to provide access of emergency equipment to buildings.
(6) 
Proper provision shall be made for open space for parks, playgrounds and other recreational facilities where appropriate.
B. 
It is intended within the body of the regulations to draw on the authority of and to enforce portions of New York State law, in particular § 335 of the Real Property Law, Article 12B of the General Municipal Law, § 10 of the Municipal Home Rule Law and portions of Article 7 of the Village Law.
C. 
The Planning Board of the Village of Islandia is thereby authorized and empowered to:
(1) 
Regulate the subdivision and development of land in accordance with these laws, the construction standards of the Village of Islandia, the Code of the Village of Islandia, the Comprehensive Plan of the Village of Islandia and make determinations relative to the individual characteristics of the site in question.
(2) 
Require the submission of plans and specifications, including the information required in Table 1,[1] approve with or without modification or disapprove preliminary plats and approve, approve conditionally or disapprove final plats.

(3) 
Review plats showing lots and blocks or sites, with or without streets or highways, and approve the development of entirely or partially undeveloped plats already filed in the office of the County Clerk.
(4) 
Exercise it's authority pursuant to § 7-738 of the Village Law without increasing the overall dwelling unit density as required by zoning regulations[2] for the location within the Village of Islandia. These dwelling units may be detached, semidetached, attached or multistory structures.

(5) 
Review plans for the erection and alteration of condominiums, homeowners associations and cooperatives in accordance with zoning regulations of the Village and these regulations.
