Except as may be permitted by the Board of Trustees pursuant to Article
V, §
161-31, of this chapter, no tennis court may be constructed or maintained on a lot or premises in an A2 Residence District or an A Residence District of the Village of Kings Point which does not comply with the provisions of this article.
No tennis court may be constructed or maintained
except as an accessory to an existing one-family dwelling located
on the same lot.
No tennis court, including the fence enclosing
it, shall be built or maintained in a front yard nor within 20 feet
of a rear or side lot line.

All tennis courts shall be enclosed with a fence that shall
be constructed and maintained in accordance with the specifications
set forth in this section for so long as the tennis court remains
in existence.
A. The height
shall be not less than eight feet nor more than 10 feet above the
playing surface. However, where the longer dimension of the court
faces a dwelling on the same lot, the center 40 feet of fence along
the side facing the dwelling may be less than eight feet in height
or eliminated completely.
B. The fence
shall be chain link, or such other material and as may be approved
by the Architectural and Preliminary Site Review Board.

C. If a chain
link fence is provided:
(1) The
fabric shall be not less than nine-gauge steel having a uniform square
mesh with two inches between parallel sides. The mesh shall have a
green, brown or black plastic coating.
(2) The
end and corner posts shall be 2 1/2 inches inside diameter galvanized
pipe with a wall thickness of 0.203 inch.
(3) The
line posts shall be two inches inside diameter galvanized pipe with
a wall thickness of 0.154 inch.
(4) The
horizontal lines shall be three horizontal rails running between the
vertical posts situated at the top, center and bottom of the chain
link fabric. These rails shall be 1 1/4 inches inside diameter galvanized
pipe having a wall thickness of 0.14 inch.
(5) The
distance between posts shall be not more than 10 feet.

A. All tennis
courts and the fencing surrounding the same shall be completely screened
from adjoining properties by a living screen of coniferous trees.
The trees shall consist of Canadian hemlock or an alternate approved
by the Building Inspector. The height of the trees, when planted,
shall be at least six feet and in no event less than two feet below
the maximum height of the fence surrounding the court. The trees shall
be planted at intervals of five feet on center, or if an alternate
other than Canadian hemlock is approved by the Building Inspector,
then at those intervals which the Building Inspector determines will
achieve the same screening effect as Canadian hemlocks. The coniferous
screening shall be maintained in good condition so long as the tennis
court remains in existence.
B. Notwithstanding
the foregoing, with regard to waterfront properties, the Architectural
and Preliminary Site Review Board may waive the requirement for screening
a tennis court from the waterfront if it finds that such screening
is not required for the benefit of adjoining properties.
The height of the playing surface of the tennis
court shall not be above the existing mean level of the ground immediately
surrounding the court area prior to construction of the court.
No tennis court shall be constructed or maintained
so as to permit any drainage water to flow onto adjacent properties
or public streets.

No system designed to illuminate a tennis court
may be installed, maintained or used.

No tennis court may be used between the hours
of 9:00 p.m. and 8:00 a.m.
Building permits and certificates of occupancy
for tennis courts must be obtained from the Building Inspector in
accordance with the provisions of the Building Code of the Village
of Kings Point.
