It shall be unlawful for weeds, grass and brush or other uncultivated vegetation to grow, or for dead weeds, grass, brush or other uncultivated vegetation to accumulate to a height in excess of eight (8) inches on any plot, parcel or piece of land within the village.
The Village Clerk shall give notice to the owner of such plot, parcel or piece of land that such condition exists by mailing to such owner a written notice at his last known address. The notice shall inform the owner that within five (5) days of receipt of the notice the owner is to cut, trim or remove such weeds, grass, brush or other uncultivated vegetation so that they do not exceed eight (8) inches in height.
A person upon whom notice has been served to cut, trim or remove such weeds, grass, brush or other uncultivated vegetation and who for five (5) days after service shall neglect or fail to comply with the provisions of any such notice shall be deemed to have violated this chapter.
If after the expiration of ten (10) days from the date of mailing the notice provided in § 40-2, the owner shall fail to comply, the Public Works Department shall have the power to cut, trim or remove such weeds, grass, brush or other uncultivated vegetation or accumulation of dead weeds, grass or brush on any plot, parcel or piece of land in the Incorporated Village of Lake Success, and the expense thereof shall be billed to the owner and, if unpaid by December 31, shall be charged to the property so affected by including such expense in the next annual tax levy against the property, pursuant to the Village Law of New York.
Any person committing an offense against any provision of this chapter shall, upon conviction, be guilty of a violation pursuant to the Penal Law of the State of New York, punishable by a fine not exceeding two hundred fifty dollars ($250.) or imprisonment for not more than fifteen (15) days, or both.
