A. 
Before any permit for the erection of a structure in a proposed subdivision shall be granted, the subdivider or its duly authorized agent shall apply for approval of such proposed subdivision in accordance with the following procedure, which procedure includes steps as set forth in §§ 93-6 through 93-9 and Chapter 105, Article XXV, § 105-233 et seq., when applicable.
B. 
Site plan review in accordance with Chapter 105, Article XXV § 105-233 et seq., shall be required if the applicant seeks to create three or more lots.
The Board shall study the sketch layout as to whether it meets the requirements of this chapter, and, to the extent it does not, the Board shall make specific suggestions as to changes to be incorporated in the preliminary plat. At the time that the informal sketch is submitted to the Planning Board, the applicant shall also submit an application and filing fee.
A. 
Within 90 days of the meeting to discuss the sketch layout, the subdivider shall submit an application for approval of the subdivision preliminary plat in conformity with these regulations. The subdivider or his duly authorized representative must attend the meeting of the Planning Board to discuss the preliminary plat.
B. 
The Planning Board shall approve, approve with modifications or disapprove the preliminary plat within 60 days. Failure of the Planning Board to act within such sixty-day period shall constitute conditional approval of the preliminary plat. Such approval shall be conditioned upon the subdivider obtaining all necessary approvals from all federal, state and local agencies having jurisdiction over the premises prior to submission of final plat.
C. 
Stormwater pollution prevention plan: A stormwater pollution prevention plan (SWPPP) consistent with the requirements of Chapter 87 shall be required for preliminary subdivision plat approval. The SWPPP shall meet the performance and design criteria and standards in Chapter 87. The approved preliminary subdivision plat shall be consistent with the provisions of Chapter 87.

A. 
Within 180 days of the conditional approval of the preliminary plat, the subdivider shall submit the final plat. This period may be extended by the Planning Board for up to two ninety-day periods beyond the 180 days.
B. 
A public hearing shall be held by the Planning Board after the submission of the final plat, which hearing shall be advertised at least once in a newspaper of general circulation in the Village and posted in three conspicuous places within the Village. Notice of the hearing shall be mailed by the applicant to all owners of properties within 200 feet of the subdivision by certified mail, not more than 20 and not less than 10 days prior to the hearing, and an affidavit of mailing shall be filed with the Village Clerk at least five days prior to the hearing. The applicant shall also erect a sign in a conspicuous location on the premises. Said sign shall indicate the name of the subdivider and the date of the public hearing.

The Planning Board may, thereupon, approve, modify and approve, or disapprove such plat or the proposed development thereof. The approval required by this chapter or the refusal to approve shall take place within 60 days from and after the time of the submission of the plat or the proposed development thereof for approval, otherwise such plat or such proposed development shall be deemed to have been approved, and the certificate of the Clerk of the Village as to the date of the submission of the plat or the proposed development thereof for approval and the failure to take action thereon within such time shall be issued on demand. The ground of refusal of any plat or proposed development submitted shall be stated upon the records of the Planning Board.
B. 
Upon completion of the above requirements and notation to that effect upon the final subdivision plat, it shall be deemed to have final approval, shall be properly signed by the Chairman of the Planning Board and shall be filed by the applicant in the office of the County Clerk. Any final subdivision plat not so filed within 90 days of the date upon which such plat is approved by reason of the failure of the Board to act shall become null and void.
C. 
The time periods herein may be extended by mutual written consent of the subdivider and the Planning Board prior to the expiration of the time period.
D. 
In the event that the subdivider does not complete each procedure within the time limits provided herein or as otherwise extended by mutual written consent, the application shall become null and void.
E. 
Stormwater pollution prevention plan: A stormwater pollution prevention plan consistent with the requirements of Chapter 87and with the terms of preliminary plan approval shall be required for final subdivision plat approval. The SWPPP shall meet the performance and design criteria and standards in Chapter 87. The approved final subdivision plat shall be consistent with the provisions of Chapter 87.
