The keeping of horses and the keeping or harboring of more than four dogs and/or more than six cats is prohibited in all districts of the Village except the Residence A and Residence AA Districts.

A. 
It shall be unlawful for any animal to be on public property or on private property without the consent of the owner or person in possession of such private property unless the animal is effectively restrained in the immediate custody and control of its owner or possessor. A person owning or possessing any such animal, which is not so restrained, with or without the knowledge, consent or fault of such person shall be guilty of a violation of this article.
B. 
It shall be presumed that the presence of an animal on the private property of a person other than the animal's owner or possessor is without the consent of the owner or person or possessor of such private property.
C. 
It shall be unlawful for any animal to habitually or frequently make such noises as to disturb the comfort or repose of any person in the immediate vicinity. The person owning or possessing such animal, committing such act with or without the knowledge, consent or fault of such person shall be guilty of a violation of this section.

Any person committing an offense against any provision of this article shall, upon conviction thereof, be guilty of a violation pursuant to the Penal Law of the State of New York, punishable by a fine up to a maximum of $1,000 or by imprisonment for a term not exceeding 15 days, or by both such fine and imprisonment. The continuation of an offense against the provisions of this article shall constitute, for each day the offense is continued, a separate and distinct offense hereunder.
