This chapter shall be known and cited as the "Lewisboro Motor Boat Ordinance."
As used in this chapter, the following terms shall have the meanings indicated:
MOTOR BOAT
Includes every vessel propelled in any manner except by sail or hand.
WATER IN THE TOWN
Includes all lakes or streams in the Town of Lewisboro over which the Town Board shall have jurisdiction by law.
No motor boat shall be operated or driven upon any water in the Town of Lewisboro in other than a careful and prudent manner or so as to endanger the safety, life or limb of any person or so as to cause damage to, on or abutting said waters or so as to interfere with the free and reasonable use of such waters by others. The operation of any motor boat in a manner contrary to the provisions hereof shall be deemed to be reckless driving. It shall be deemed reckless driving to operate a boat towing a person on water skis, surfboard or similar device unless there is in said boat a person in addition to the operator thereof of at least 10 years of age in a position to observe the progress of the person being towed as required by § 73 of the Navigation Law of the State of New York.
A. 
The use on Lake Waccabuc of any motor boat with motor propulsion exceeding 25 horsepower, based upon the manufacturer's rating, is prohibited.
B. 
The use on Lake Oscaleta or Lake Rippowam of any motor boat with motor propulsion exceeding 10 horsepower, based upon the manufacturer's rating, is prohibited.
No person shall operate a motor boat and no owner shall permit the operation of a motor boat on waters in the Town unless such motor boat is registered and numbered in compliance with the provisions of Article 48 of the Vehicle and Traffic Law of the State of New York.
A. 
No motor boat shall be operated or driven upon any waters in the Town before 8:30 a.m. or after 1/2 hour after sunset.
B. 
No motor boat shall be used for towing a person on water skis, a surfboard or similar device before 10:00 a.m. or after 4:00 p.m.
Any person violating any of the provisions of the within chapter shall be guilty of an offense and upon conviction thereof shall be punishable by a fine not exceeding $100.
