This chapter is enacted pursuant to authority of Chapter 365 of the
Laws of 1976, which added a new Subparagraph (3) to Paragraph d of Subdivision
1 of § 10 of the Municipal Home Rule Law, authorizing towns to adopt
a local law which may amend or supersede any provision of the Town Law in
relation to the property, affairs or government of the Town or in relation
to any of the other enumerated subject matters in § 10, unless there
is a state legislative restriction on such amendment or supersession or it
is inconsistent with the New York State Constitution.
A.
The Town Board of the Town of Mamakating does hereby
create and establish a Department of Buildings, Grounds, Parks and Water and
the position of Director of the Department of Buildings, Grounds, Parks and
Water.
B.
Powers and duties.
(1)
The Town of Mamakating Department of Buildings, Grounds
Parks and Water shall oversee all Town buildings, grounds, water districts,
recreation areas and parks and such other areas assigned by the Town Board.
(2)
The Town of Mamakating Director of the Department of
Buildings, Grounds, Parks and Water shall be responsible for oversight of
all Town buildings, grounds, water districts, recreation areas and parks,
and such other areas assigned by the Town Board, and shall be responsible
for the direct supervision of Department staff and outside contractors employed
in accordance with the Town's procurement policies to fill the Department's
assignments. The Director's immediate supervisor will be the Town Supervisor
on behalf of the Town Board.
Section 23 of the Town Law is hereby amended and superseded in its application
to the Town of Mamakating to provide that the Director of Buildings, Grounds,
Parks and Water, at the time of his/her appointment and through his/her term
of office, need not be an elector in the Town so long as he or she is a resident
of the Counties of Sullivan or Orange of the State of New York.
A.
The Director of the Department of Buildings, Grounds,
Parks and Water shall have the following minimum qualifications:
(1)
A bachelor's degree in a related field with four
years' work experience in the field, two years of such work to be in
a management position; or
(2)
Possession of an associate's degree (or a comparable
number of credits) in a related field with four years' work experience
in the field, four years of such work to be in a management position; or
(3)
Eight years' work experience in a related field,
four years of such work to be in a management position.
B.
Required knowledge, skills and abilities. The Director
of the Department of Buildings, Grounds, Parks and Water shall:
(1)
Be knowledgeable of buildings, grounds and landscaping
maintenance;
(2)
Have a working knowledge of rules and regulations related
to fire and safety codes, OSHA, environmental impact and the like;
(3)
Have the ability to promote, plan and organize related
activities;
(4)
Have the ability to supervise the work of staff and oversee
the work of independent contractors;
(5)
Have the ability to organize a department, prepare reports
related to its activities, operate a budget and be proficient in Microsoft
Office or similar computer programs as are necessary to perform the work prescribed;
(6)
Prepare budget recommendations for the Town Supervisor
and Town Board;
(7)
Oversee and approve budget revenues and expenditures;
(8)
Requisition materials, equipment and supplies;
(9)
Prepare daily and weekly assignments for staff and supervise
their performance, and
(10)
Oversee the maintenance of equipment and grounds.
The Director of the Department of Buildings, Grounds, Parks and Water
shall be appointed by the Town Board of the Town of Mamakating.
A.
The term of office of the Director of the Department
of Buildings, Grounds, Parks and Water shall be three years. The terms for
the appointed Director of Buildings, Grounds, Parks and Water shall commence
on the first day of January 2003, and each three years thereafter.
B.
Vacancy. In the event of a vacancy, the Town Board of
the Town of Mamakating shall appoint a temporary Director of the Department
of Buildings, Grounds, Parks and Water to complete the balance of the term.
The position of appointed Director of the Department of Buildings, Grounds,
Parks and Water shall be in the classified service.
Compensation of the Director of the Department of Buildings, Grounds,
Parks and Water shall be fixed in accordance with § 27 of the Town
Law.
