This chapter shall be known and may be cited as the "Amended Mobile Home Ordinance of the Town of Mamakating."
It is the purpose of this chapter to promote the health, safety and welfare of the inhabitants of the Town of Mamakating and regulate the maintenance of mobile homes and mobile home parks within the Town of Mamakating and to prescribe regulations for said parks, to regulate the parking and location of mobile homes inside or outside of said parks within the Town of Mamakating and to require that mobile home parks within the Town of Mamakating be laid out and constructed in accordance with approved plans.
As used in this chapter, the following terms shall have the meanings indicated:
MOBILE HOME
A vehicular, portable structure built on a chassis and designed to be used without a permanent foundation as a dwelling when connected to utilities as per the definition as stated in the State Uniform Fire Prevention and Building Code. It is the intention of this chapter to exclude recreational vehicles which are defined in said code as a vehicular-type unit primarily designed as temporary living quarters for recreational camping or travel use, which either has its own motive power or is mounted on or drawn by another vehicle. Also excluded are travel trailers, camping trailers and truck campers as defined in said code.
MOBILE HOME PARK
Any plot of ground upon which two or more mobile homes occupied for dwelling or sleeping purposes are located, regardless of whether or not a charge is made for such accommodations.
MOBILE HOME SPACE
The lot or space in any park which shall be assigned to or used and occupied by any one mobile home.
A. 
No person, firm or corporation being the owner or occupant or lessee of any land or premises within the Town of Mamakating shall use or permit the use of said land or premises as a mobile home park without obtaining a permit therefor as hereinafter provided.
B. 
No person, firm or corporation being the owner, lessee or occupant of any land or premises within the Town of Mamakating or being the owner of a mobile home as herein defined on and after the effective date of this chapter shall use or permit the use of said land or premises or the use of any mobile home upon such land. This prohibition shall not apply to mobile homes outside of mobile home parks previously placed pursuant to validly issued permits nor to replacements of such mobile homes as hereinafter provided.
No mobile home, as defined in this chapter, shall be placed or maintained upon any lands or premises within the Town of Mamakating, nor shall any mobile home be occupied within the Town of Mamakating, except as permitted by this chapter, and no application for a permit for a mobile home park shall be filed by an applicant or accepted by the Town Clerk of the Town of Mamakating unless:
A. 
In the case of mobile home parks:
(1) 
The mobile home park plans shall have been presented to the Town of Mamakating Planning Board for its prior approval as to location, compatibility with Town of Mamakating Master Plan development and compliance with the requirements of this chapter; and
(2) 
After enactment of a zoning ordinance of the Town of Mamakating, a building permit for special use shall have first been obtained as required by such zoning ordinance.[1]

B. 
In the case of mobile homes outside of mobile home parks:
(1) 
No new mobile home applications shall be permitted.
(2) 
Mobile homes placed within the Town of Mamakating pursuant to previously validly issued mobile home permits shall be permitted to remain in their original location.
(3) 
Existing mobile homes may be relocated on the same lot or replaced, provided that such relocation or replacement mobile homes meet the requirements of this chapter, the bulk requirements in the Town Zoning Ordinance[2] for a one-family dwelling in the appropriate zone, and all provisions of the New York State Uniform Fire Prevention and Building Code regulating mobile homes. A report from a New York State P.E. must be submitted either stating that the existing septic system is suitable for the new unit or providing a recommendation as to what improvements would be required. In the case of a replacement, the original mobile home must be removed from the lot.
