This chapter shall be known and may be cited as the "Manufactured Homes Within the Town of Manchester Law."
It is the purpose of this chapter to assure quality development and maintenance while promoting the health, safety, and general welfare of the inhabitants equal to that found in other types of residential areas of the Town of Manchester by the more efficient regulations of manufactured home and the manufactured home community by establishing minimum standards for the development, design and maintenance of Manufactured Home Community Districts and the expansion of preexisting mobile home parks. It is not the intent of this chapter to repeal or abrogate any part of applicable codes of New York State. The provisions of this chapter shall be enforced in addition to and in conjunction with the codes of New York State.
The terms used in this chapter shall have the meanings set forth in Chapter 325, Zoning, § 325-4.
A. 
Approval of Planning Board. The Planning Board may, after the establishment of a Manufactured Home Community District by the Town Board, approve a manufactured home community located in such manufactured home community district.
B. 
Application.
(1) 
Application for a Manufactured Home Community District new development, new development or expansion of a preexisting mobile home park shall be submitted to the Town of Manchester's Code Enforcement Office, who shall, upon receipt, transmit the application to the Planning Board. No application shall be accepted or considered complete, or scheduled for public hearing until all required materials have been submitted and deemed to be complete and accurate by the Planning Board.
(2) 
The application shall be accompanied by the following:
(a) 
Preliminary plan. Meeting the requirements for a manufactured home community under the manufactured home community regulations. Nine copies shall be submitted.
(b) 
Statement. A written statement describing the proposed method of providing and administering a water supply and sewage disposal systems and of owning and administering open space land. Nine copies shall be submitted.
(c) 
Other information. The Planning Board may request the submission of such additional information or copies as it deems necessary in order to decide on the application.
(d) 
Application fee. Prior to the issuance of a permit for a manufactured home community or the renewal of any such permit, the owner of the park shall pay to the Town such fees as may from time to time be adopted by the Town Board.
C. 
Site development plan. A site development plan, review and approval is required as set forth in Chapter 325, Zoning, § 325-75, Site plan approval, for development of all manufactured home community expansions.
Every manufactured home park as defined in this chapter in existence on June 19, 1967, shall be permitted to continue in operation of its existing facilities but such park must be licensed under the terms of this chapter pursuant to application made under § 120-5, but the physical requirements of the plan, manufactured home lots and layout for such park may be varied by the Town Board from strict conformity in the event the improvements existing on the premises on June 19, 1967, make full compliance impossible or the existing provisions respecting such use and occupation are adequate to the existing health and safety requirements.
A. 
Vested interest not to be construed. None of the provisions of this chapter shall be construed as granting vested interest to anyone licensed under this chapter, and the Town Board hereby reserves the right to withdraw all permissions and revoke all licenses granted under this chapter upon 60 days' notice by publication and posting as provided in § 133 of the Town Law.
B. 
Compliance with zoning regulations. None of the provisions of this chapter shall be construed in any way to permit the maintaining of manufactured homes or manufactured home parks in any zoning district wherein they are prohibited in Chapter 325, Zoning, of the Code of the Town of Manchester.
C. 
Nonapplicability to villages. None of the provisions of this chapter shall be applicable within the limits of any incorporated village located in the Town.
