A. 
Wherever used in this article, the following terms shall have the same meanings as defined in Title I, Article 1, of the Vehicle and Traffic Law of the State of New York: "public highway," "street," "curb," "crossing," "intersection," "vehicle," "motor vehicle," "motorcycle," "driver," "omnibus," "pedestrian," "operator," "owner," "park," "parking," "parked," "parking space," "one-way traffic," "safety zone," "traffic control signals," "official traffic signs and signals" and "sidewalk."
B. 
As used in this article, the following terms shall have the meanings indicated:
CHIEF OF POLICE
The head of the Police Department of the City of Middletown, New York.
DRIVEWAY or ROADWAY
Includes all areas used by vehicles for entrance to or exit from private lands where such areas intersect with a public highway without curb thereon and all such areas where the street has been ramped to private land without curb.
LEGAL HOLIDAYS
Whenever used in this article, shall have the same meaning as defined in Article 2, § 24, of the General Construction Law of the State of New York.

LONG-TERM PARKING
Parking for a period of more than two hours.

SHORT-TERM PARKING
Parking for a duration of two hours or less.

TRUCK LOADING ZONE
The area or space officially set apart within a street or roadway for the loading or unloading of goods, wares or merchandise, which is so marked or indicated by signs which have to be plainly visible at all times while set apart as such for the loading or unloading of trucks, trailers or semitrailers.

Every person operating a motor vehicle upon public streets shall drive such vehicle in a careful and prudent manner so as not to endanger the property of another or life or limb of any person.
A. 
No person shall operate, propel or drive a motor vehicle or motorcycle on any of the public streets or other highways or public places in the City of Middletown, New York, at a rate of speed in excess of 30 miles an hour.

B. 
No person shall operate, propel or drive a motor vehicle or motorcycle in the roads and driveways of Fancher-Davidge Park or on South Street between Grandview Avenue and Randall Terrace of the City of Middletown, New York, at a rate of speed in excess of 20 miles per hour. No person shall operate, propel or drive a motor vehicle or motorcycle on Magar Road from the City line and State Street at a rate of speed in excess of 25 miles per hour.

C. 
No person shall operate, propel or drive a motor vehicle or motorcycle upon any of the public streets, highways or other public places in the City of Middletown, New York, designated as school crossing at a rate of speed in excess of 20 miles an hour.
D. 
The penalty for violation shall be according to § 1180(h) of the Vehicle and Traffic Law of New York State.

A. 
Highland Place.
(1) 
Highland Place shall be closed to public traffic, and local traffic only shall be permitted.
(2) 
No person shall operate, propel or drive a motor vehicle on Highland Place at a rate of speed in excess of 15 miles per hour.
No person, except a policeman or an officer of the Fire Department, operating a motor vehicle or driving any other kind of vehicle shall pass, attempt to pass or race or offer any hindrance or obstruction to any vehicle or apparatus in use by the Fire or Police Department when engaged in responding to, attending upon or returning from an alarm or call; or drive or propel such motor or other vehicle upon any public highway, street or place in this City within a distance of 600 feet from any fire location or from any vehicle or apparatus in use or which has been in use by either of said Departments when the same shall be responding or shall have responded to an alarm or call; or drive or propel such motor or other vehicle so as to endanger the safety of those operating any vehicle or apparatus so in use by either of said Departments.
It shall be unlawful, without authority or the consent of the Fire Chief or his assistant in command, for any person to run, drive or draw or cause to be run, driven or drawn any horse or other animal, motor vehicle, wagon, cart, electric or steam railroad car, locomotive or other vehicle over or upon or willfully injure or damage or in any manner molest or interfere with any unprotected hose belonging to the Fire Department of the City of Middletown laid on or in any vacant lot or street, alley, public ground or other public place at the occurrence of a fire or any alarm of fire or for any other purpose.
No vehicle shall be stopped or left standing within 10 feet of any fire hydrant, in front of or within 20 feet of either side of the entrance to any firehouse, unless said vehicle is actually in charge of some person capable of driving it.

No person(s) shall park any detached trailer in any residential area between the hours of 10:00 p.m. and 6:00 a.m. except with the permission of the Common Council.
No vehicle shall be stopped or left standing in front of any driveway or roadway extending from the street or to premises adjacent to the street, nor within four feet of either side of any such driveway or roadway, unless such vehicle is left in charge of some person capable of driving it.
A. 
Specific turns prohibited.

(1) 
No vehicle shall back to make a turn in North Street, between Franklin Square and Courtland Street; in James Street, between Depot Street and West Main Street; or in any other street, if by doing so it shall interfere with traffic or other vehicles, nor shall any vehicle negotiate a U-turn in or upon any portion of the area known as Franklin Square.

(2) 
There shall be no ingress or egress for nonemergency vehicles into or out of the Second Baptist Church parking lot from or into Grove Street.
B. 
Left turns.[1]
(1) 
No vehicle proceeding in an easterly direction on Monhagen Avenue shall be permitted to make a left turn into Mill Street.

No vehicle shall make a right turn on a red light at the intersection of West Main Street and Monhagen Avenue going in either direction on West Main Street or Monhagen Avenue.

Regulation and control of municipal parking lots. No motorcycle, motor vehicle or vehicle shall stand, be left standing or park at any time in any parking lot described in this section outside the time periods listed. With respect to timed parking spaces, moving from one parking space to another in the same parking lot does not extend the time limitations of such restriction. For the purpose of this section, a commercial vehicle shall be any vehicle that has more than six wheels or is longer than 25 feet. The Department of Public Works shall install appropriate signage to implement the provisions and restrictions contained in this section.
A. 
James Street parking lot: Lot No. 1.
(1) 
Except as provided by Subsection A(4) below, this entire lot shall be limited to four-hour parking between the hours of 7:00 a.m. and 12:00 a.m., Sunday through Saturday.
(2) 
On the south side of this lot, there shall be no parking from 4:00 a.m. to 7:00 a.m., Sunday through Saturday.
(3) 
No commercial vehicles are authorized to park in this lot.
(4) 
Overnight parking on the north side of this lot shall be allowed only by permit. Overnight permits are valid between the hours of 8:00 p.m. and 7:00 a.m. During the hours from 7:00 a.m. to 8:00 p.m., vehicles with overnight permits are subject to the four-hour limit imposed by Subsection A(1), above.
(5) 
Electric charging spaces are for use by electric vehicles only, while charging, up to a maximum of four hours.
B. 
East Main Street parking lot (7-27 East Main Street): Lot No. 2.
(1) 
Except as provided by Subsection B(4) below, this lot shall be limited to four-hour parking between the hours of 7:00 a.m. and 12:00 a.m., Sunday through Saturday.
(2) 
No commercial vehicles are authorized to park in this lot.
(3) 
Parking of motorcycles is allowed in designated spaces only.
(4) 
Overnight parking in this lot shall be allowed only by permit. Overnight permits are valid between the hours of 8:00 p.m. and 7:00 a.m. During the hours from 7:00 a.m. to 8:00 p.m., vehicles with overnight permits are subject to the four-hour limit imposed by Subsection B(1), above.
C. 
West Main Street parking lot (adjacent to 28 West Main Street): Lot No.3.
(1) 
Except as provided by Subsection C(3) below, this lot shall be limited to four-hour parking between the hours of 7:00 a.m. and 12:00 a.m., Sunday through Saturday.
(2) 
No commercial vehicles are authorized to park in this lot.
(3) 
Overnight parking in this lot shall be allowed only by permit. Overnight permits are valid between the hours of 8:00 p.m. and 7:00 a.m. During the hours from 7:00 a.m. to 8:00 p.m., vehicles with overnight permits are subject to the four-hour limit imposed by Subsection C(1), above.
D. 
West Main Street parking lot (between 12 West Main Street and 20 West Main Street, extending to South Street): Lot No. 4.
(1) 
Except as provided by Subsection D(4) below, this lot shall be limited to four-hour parking between the hours of 7:00 a.m. and 12:00 a.m., Sunday through Saturday.
(2) 
No commercial vehicles are authorized to park in this lot.
(3) 
Ingress to this lot shall be from West Main Street only. Egress from this lot shall be to South Street only.
(4) 
Overnight parking in this lot shall be allowed only by permit. Overnight permits are valid between the hours of 8:00 p.m. and 7:00 a.m. During the hours from 7:00 a.m. to 8:00 p.m., vehicles with overnight permits are subject to the four-hour limit imposed by Subsection D(1), above.
E. 
South Street parking lot (adjacent to 2-8 South Street and extending behind 2-8 South Street and along Washington Street, on two levels, designated as upper and lower levels): Lot No. 5.
(1) 
Except as provided by Subsection E(3) below, the upper level in this lot shall be limited to four-hour parking between the hours of 7:00 a.m. and 12:00 a.m., Sunday through Saturday.
(2) 
No commercial vehicles are authorized to park in the upper or lower levels of this lot.
(3) 
Overnight parking in the upper level of this lot shall be allowed only by permit. Overnight permits are valid between the hours of 8:00 p.m. and 7:00 a.m. During the hours from 7:00 a.m. to 8:00 p.m., vehicles with overnight permits are subject to the four-hour limit imposed by Subsection E(1), above.
(4) 
Parking in the lower level of this lot shall be allowed for a maximum of 72 hours.
(5) 
Electric charging spaces are for use by electric vehicles only, while charging, up to a maximum of four hours.
F. 
Paramount Theatre parking lot (adjacent to 17-19 South Street): Lot No. 6.
(1) 
Parking in this lot is permitted only for persons attending the Paramount Theatre on the same day of the parking. Parking is permitted for such theater patrons from 8:00 a.m. to 12:00 a.m., Sunday through Saturday.
(2) 
No parking is allowed in this lot from 4:00 a.m. to 7:00 a.m., Sunday through Saturday.
(3) 
No commercial vehicles are authorized to park in this lot.
G. 
South Street lot [adjacent to 26 South Street and across from 25 South Street (the court building)]: Lot No. 7.
(1) 
Parking in this lot shall be allowed for a maximum of 72 hours.
(2) 
No commercial vehicles are authorized to park in this lot.
H. 
Canal Street parking lot: Lot No. 8.
(1) 
Parking in this lot shall be allowed for a maximum of 72 hours.
(2) 
No commercial vehicles are authorized to park in this lot.
I. 
Erie Station/adjacent to 90 North Street: Lot No. 9.
(1) 
Except as provided by Subsection I(3) below, this lot shall be limited to four-hour parking between the hours of 7:00 a.m. and 12:00 a.m., Sunday through Saturday.
(2) 
No commercial vehicles are authorized to park in this lot.
(3) 
Overnight parking in this lot shall be allowed only by permit. Overnight permits are valid between the hours of 8:00 p.m. and 7:00 a.m. During the hours from 7:00 a.m. to 8:00 p.m., vehicles with overnight permits are subject to the four-hour limit imposed by Subsection I(1), above.
J. 
The Second Baptist Church parking lot (on North Street, between 123 North Street and 135 North Street and extending to Grove Street): Lot No. 10.
(1) 
Parking in this lot shall be allowed for a maximum of 72 hours.
(2) 
No commercial vehicles are authorized to park in this lot.
K. 
Courtland Street parking lot: Lot No. 11.
(1) 
Parking in this lot shall be allowed for a maximum of 72 hours.
(2) 
No commercial vehicles are authorized to park in this lot.
L. 
The Railroad Avenue/North Street corner lot: Lot No. 12.
(1) 
Except as provided by Subsection L(3) below, this lot shall be limited to four-hour parking between the hours of 7:00 a.m. and 12:00 a.m., Sunday through Saturday.
(2) 
No commercial vehicles are authorized to park in this lot.
(3) 
Overnight parking in this lot shall be allowed only by permit. Overnight permits are valid between the hours of 8:00 p.m. and 7:00 a.m. During the hours from 7:00 a.m. to 8:00 p.m., vehicles with overnight permits are subject to the four-hour limit imposed by Subsection L(1), above.
M. 
The North Street parking lot adjacent to 101 North Street: Lot No. 13.
(1) 
This lot shall be limited to four-hour parking between the hours of 7:00 a.m. and 12:00 a.m., Sunday through Saturday.
(2) 
No parking is allowed in this lot from 4:00 a.m. to 7:00 a.m., Sunday through Saturday.
(3) 
No commercial vehicles are authorized to park in this lot.
N. 
Henry Street lot: Lot No. 14.
(1) 
Parking in this lot shall be allowed for a maximum of 72 hours.
(2) 
No commercial vehicles are authorized to park in this lot.
O. 
The Salvation Army building parking lot (between Mill Street and Hanford Street): Lot No. 15.
(1) 
No parking is allowed in this lot from 4:00 a.m. to 7:00 a.m., Sunday through Saturday.
(2) 
No commercial vehicles are authorized to park in this lot.
P. 
Erie Way, between North Street and Cottage Street: Lot No. 16.
(1) 
Parking in this lot shall be allowed for a maximum of 72 hours.
(2) 
No commercial vehicles are authorized to park in this lot.
Q. 
Coach USA lot: Lot No. 17.
(1) 
Parking in this lot shall be allowed for a maximum of 72 hours.
R. 
The City parking lot, between Cottage Street and Montgomery Street: Lot No. 18.
(1) 
Parking in this lot shall be allowed for a maximum of 72 hours.
(2) 
Electric charging spaces are for use by electric vehicles only, while charging, up to a maximum of four hours.
(3) 
No commercial vehicles are authorized to park in this lot.
S. 
The Watts Park parking areas along Wisner Avenue and Watkins Avenue.
(1) 
No parking shall be allowed along Wisner Avenue from 2:00 a.m. to 8:00 a.m. on Wednesday.
(2) 
No parking shall be allowed along Watkins Avenue from 2:00 a.m. to 8:00 a.m. on Thursday.
(3) 
No commercial vehicles are authorized to park in this lot.
T. 
Orchard Street parking lot. Lot No. 19.
(1) 
Except as provided by Subsection T(3) below, this lot shall be limited to eight-hour parking between the hours of 7:00 a.m. and 12:00 a.m., Sunday through Saturday.
(2) 
No commercial vehicles are authorized to park in this lot.
(3) 
Overnight parking in this lot shall be allowed only by permit. Overnight permits are valid between the hours of 8:00 p.m. and 7:00 a.m. During the hours from 7:00 a.m. to 12:00 p.m., vehicles with overnight permits are subject to the eight-hour limit imposed by Subsection T(1), above.
U. 
Union Street lot: Lot No. 20.
(1) 
This lot shall be limited to four-hour parking between the hours of 7:00 a.m. and 12:00 a.m., Sunday through Saturday.
(2) 
No commercial vehicles are authorized to park in this lot.
(3) 
No parking is allowed in this lot between the hours of 12:00 a.m. and 7:00 a.m.
V. 
Rail Trail Commons lot: Lot No. 21.
(1) 
This lot shall be limited to four-hour parking between the hours of 7:00 a.m. and 12:00 a.m., Sunday through Saturday.
(2) 
No commercial vehicles are authorized to park in this lot.
(3) 
No parking is allowed in this lot between the hours of 12:00 a.m. and 7:00 a.m.
W. 
The North Street parking lot adjacent to 118-118.5 North Street: Lot No. 22.
(1) 
This lot shall be limited to four-hour parking between the hours of 7:00 a.m. and 12:00 a.m., Sunday through Saturday.
(2) 
No parking is allowed in this lot between the hours of 12:00 a.m. and 7:00 a.m.
(3) 
No commercial vehicles are authorized to park in this lot.

No motorcycle, motor vehicle or any other vehicle of any type shall stand, be left standing, stop, park or be operated contrary to any rules, regulations and/or signage approved and/or adopted and/or installed from time to time by the Board of Education of the Enlarged City School District of Middletown with respect to roadways, lanes or parking areas on district property located at and used at the Middletown High School, the Presidential Park Elementary School, the Truman Moon Elementary School and/or the Twin Towers Middle School.

A. 
The City will issue a limited number of overnight parking space permits for each City lot which allows overnight parking. Such permits must be obtained by application to the City Clerk's office.
B. 
Overnight parking permits are valid for one calendar year and may be obtained for a fee of $120. In the discretion of the City Clerk, a short-term permit may be issued when there is less than two months before the end of a calendar year at a fee of $10 per month; such short-term permit may not exceed two months. Permits must be paid for in full prior to issuance. No refunds shall be issued for any permits.
C. 
Overnight permits shall be issued for a specific vehicle only. Permits are not transferable to other vehicles.
D. 
All overnight permits will be issued in sticker form, and the stickers must be attached to the rear driver side window in such a manner so as to be visible from the outside.
E. 
All overnight permits will be color coded by lot. Permits are lot specific and are not interchangeable with other City lots.

A. 
The City Clerk, in his/her discretion and upon application, may issue temporary long-term parking permits to City residents who require parking in excess of 72 hours, for specific events, such as, but not limited to, vacations or business trips. Such permits are valid for a period of one week only. No more than two such permits may be issued at the same time.
B. 
Long-term permits are valid only in parking lots which allow overnight parking.
C. 
Long-term permits require a fee of $5, which must be paid in full prior to issuance.
D. 
Long-term permits shall be issued for a specific vehicle only. Permits are not transferable to other vehicles.
E. 
All long-term permits must be hung from the rearview mirror in such a manner so as to be visible from the outside.
F. 
All long-term permits will be color coded by lot. Permits are lot specific and are not interchangeable with other City lots.
No motor vehicle or vehicles of any description shall be allowed to enter upon or pass over any portion of the following named streets or avenues except in the direction indicated. Movement of traffic of any nature in the opposite direction, as indicated, is prohibited:
Academy Avenue, between Dolson Avenue and Bennett Street, in a southerly direction.

Every operator of a vehicle or other conveyance traversing any street intersecting the through streets designated shall bring such vehicle or conveyance to a full stop at the place where such street meets the prolongation of the nearest property line of such through street; subject, however, to the direction of any traffic control signal or sign of any police officer at such intersection.

The operator of any vehicle who has come to a full stop, as required above, upon entering the through street, as well as operators of vehicles on such through street, shall be subject to the usual right-of-way rule prescribed by law and applicable to vehicles at intersections.

All such signs shall be illuminated at night or so placed as to be illuminated by streetlights or the headlights of approaching motor vehicles.

The parking of vehicles is hereby prohibited on all highways and streets within the City between the hours of 2:00 a.m. and 6:00 a.m. from the first day of December until and including the 15th day of March of each year, except for any vehicle permitted through the Office of the City Clerk, or on the following street(s): the westerly side of Rivervale Road. The owners or operators of vehicles parked in violation of this subsection are subject to the penalties, including removal, provided in § 460-41 of this chapter.
B. 
City residents who do not have a driveway or access to off-street parking may apply to the Office of the City Clerk for a winter season street parking permit, which would entitle such residents to park their vehicle in a legal parking space on the street, within 100 feet of the boundary of their property, during the time periods referenced in Subsection A, above. However, it shall be the obligation of the vehicle owner or operator to remove such permitted vehicle from the street during any periods of snow alert, precipitation or other emergency in accordance with the provisions of §§ 460-22, 460-75 and 460-81. The owners or operators of vehicles parked in violation of this subsection are subject to revocation of their winter season street parking permit in the discretion of the Mayor, as well as to the penalties, including removal, provided in § 460-41 of this chapter.
C. 
The provisions of Subsection B, above, shall not apply to residences located in the DMU Downtown Mixed-Use zoning district, and no winter season overnight parking permits shall be issued for any location in the DMU zoning district.

The City of Middletown Board of Estimate and Apportionment is hereby given the authority to set reasonable fees for the issuance of any winter season overnight parking permits pursuant to Subsection B, above.

Except as otherwise provided in this article and in Subsection A, below, all streets in the Business Improvement District, as defined in Chapter 203 of this Code, shall be three-hour parking zones. No vehicle shall stand or be parked or be left standing or parked for more than three hours between the hours of 8:00 a.m. to 11:00 p.m., Sunday through Saturday.

Hill Street on the southerly side between Lafayette Avenue and Prospect Avenue.
It shall be unlawful to delay, hinder or obstruct any vehicles or equipment engaged in the operation of snow plowing or snow removal in the City streets. After a precipitation of snow of 2 1/2 inches or more, and thereafter until the streets are plowed and cleared of snow, it shall be unlawful for any person to park any vehicle upon any street while said street is being plowed or cleared unless such vehicle is attended by a person capable of operating it. The owner or a person in charge of or in control of any vehicle standing in any street shall move or cause the same to be moved so as not to be in the path of the equipment plowing or clearing the street of snow.
The parking in excess of five minutes of motor vehicles commonly known as "auto trucks" used for the transportation of goods, wares and merchandise, except for the purpose of loading and unloading such goods, wares and merchandise actually conveyed or to be conveyed by said auto truck, is hereby forbidden on the following locations:
Budd Avenue.

The parking of uninspected, unregistered, junk motor vehicles and motor vehicles for sale in City-owned or -operated parking lots and on City streets is prohibited.

It shall be unlawful to park any motorized vehicle equipped with over six wheels on any street in any residential zoning district or on any street abutting a residential zoning district during the hours from dusk to dawn. Persons who violate this section are subject to a fine of $150 for each violation. In addition, any vehicle violating this section may be towed or removed or caused to be removed under the direction of the Police Department or the Commissioner of Public Works without notice to the owner. The charge for such removal shall consist of the amount of all the expenses actually and necessarily incurred in effecting such removal. Such charges shall not exceed those charges described in Chapter 440, Towing, in addition to any charges for storage. Such storage charges shall be in conformity with Chapter 440, and such amount shall be charged to the owner or person in charge of the subject vehicle. No vehicle shall be released until the owner or person in charge pays all towing and storage fees associated with the removal.

B. 
Every operator of a bus line, when approaching a railroad crossing in this City, shall bring his vehicle to a full stop at a distance not less than 15 feet from such crossing, and shall not again put such vehicle in motion until he is assured that it is safe for such vehicle to proceed over such crossing.
A. 
No bus engaged in the carriage of passengers for hire shall park or stop upon Depot Street, Center Street or upon James Street from the Erie crossing to Henry Street, for any purpose whatever, except that a bus may stop for a period of not longer than one minute for the purpose of receiving or discharging passengers, provided that the stopping of such bus is at a point which leaves a space sufficient on its left side for the passage of traffic in both directions.
B. 
The driver of a bus stopping for a period longer than one minute, or at a point other than above specified on any of the said streets, shall be guilty of a traffic infraction and punishable by a fine not exceeding $50 or by imprisonment in the county jail for not more than 10 days, or by both such fine and imprisonment.
A. 
Except for the purpose of taking on or discharging passengers, or while loading or unloading merchandise, furniture or other wares, it shall be unlawful for buses, trucks and all other commercial vehicles of any nature weighing 6,000 pounds or more to pass over or use any portion of the following streets:

A. 
No person or persons shall ride any bicycle, tricycle, motorcycle, motor bicycle or motor tricycle over or upon any sidewalk or footpath intended for the use of pedestrians or within any public park within the limits of the City. This section shall not apply to persons who cannot walk by reason of being invalids or cripples, nor to children under 10 years riding on tricycles or small bicycles.
B. 
No person or persons shall ride or propel any bicycle, motorcycle, motor bicycle or motor tricycle upon any of the streets, avenues or public places within said City at a greater rate of speed than 30 miles per hour.
C. 
All bicycles and motorcycles shall be equipped as required by the Vehicle and Traffic Law of the State of New York.

D. 
A violation of this section is an offense punishable by a fine not less than $50 nor more than $500 or by imprisonment for a period not exceeding 15 days, or by both such fine and imprisonment.

A. 
Any person who is either the owner, driver or person in charge of any vehicle shall, when requested by a police officer of the City of Middletown, New York, move such vehicle from any position or place in which it may be standing to another position or place as requested or directed by such police officer.
B. 
The Department of Police is hereby authorized to cause the removal of any parked or standing vehicle when the parking of such vehicle is considered to be hazardous to the safe operation of traffic or to interfere with emergency operations of the municipality or public service organization or when parked in violation of any provisions of the law.
C. 
When any such vehicle is so removed, it shall be transported to a suitable storage space. A record shall be made of the license number of the vehicle and the location at which the vehicle is stored, and the owner thereof shall be notified by the Police Department of the place where said vehicle is located.
D. 
The cost of the removal and storage of such vehicle shall, in the case of illegal parking by the operator of said vehicle, be levied against the owner thereof.
A. 
Notwithstanding the provisions of any existing law, ordinance or resolution of the City, the Chief of Police is hereby authorized and it shall be his duty, whenever the public interest and safety require, to make, establish and enforce rules and regulations governing the following:
(1) 
The establishment of parking spaces.
(2) 
The establishment of loading zones.
(3) 
The establishment of bus, cab and taxicab stands.
(4) 
The establishment of safety zones.
(5) 
The establishment of safety regulations at intersections.
(6) 
The operation of official traffic signs; provided, however, that any traffic signal heretofore or which may be hereafter discontinued by order of the Common Council shall not again be placed in operation without its authority.
B. 
Rules and regulations established hereunder shall have the same force and effect as ordinances and laws passed by the Common Council pertaining thereto, and any violation of any regulations designated by the Chief of Police pursuant to this article shall be punishable as provided in § 1800 of the Vehicle and Traffic Law of the State of New York.

C. 
The Common Council reserves the right by a majority vote of the Aldermen elected and in office to revoke any rule or regulations promulgated in conformity with this article.

A. 
Prohibited acts. No person, with the intent to cause public inconvenience, annoyance or alarm, or recklessly creating a risk thereof, shall cause, suffer, allow or permit to be made unreasonable noise while operating any motor vehicle or bicycle. For purposes of this section, "unreasonable noise" is defined as any disturbing, excessive, or offensive sound that disturbs a reasonable person of normal sensitivities.
B. 
Prima facie evidence of violation. The following acts are declared to be prima facie evidence of a violation of this section. This enumeration shall not be deemed exclusive:
(1) 
Any unnecessary noise from any motor vehicle or bicycle between the hours of 11:00 p.m. and 7:00 a.m. the following day.
(2) 
Noise from an alarm system of any motor vehicle which is continuous and exceeds 15 minutes.
(3) 
Noise from any sound reproduction system, operating or playing any radio, portable radio or tape player, television, tape deck, compact disc player or similar device located in or affixed to a motor vehicle or bicycle that reproduces or amplifies sound in such a manner as to be heard 60 feet from its source.
(4) 
The sounding of any horn or signaling device of a motor vehicle for any unnecessary or unreasonable period of time.
(5) 
The making of improper noise or disturbance or operating a motor vehicle in such a manner as to cause excessive squealing or other excessive noise of the tires.
C. 
Exceptions. The provisions of this section shall not apply to the following acts:
(1) 
The emission of sound for the purpose of alerting persons to the existence of an emergency.
(2) 
Noise from municipally sponsored celebrations or events.
(3) 
Noise from individually sponsored events where a permit for public assembly or other relevant permission has been obtained from the Common Council.
D. 
Penalties. Any person violating any of the provisions of this section shall be deemed guilty of a traffic infraction as defined by the Vehicle and Traffic Law of the State of New York and shall be subject to a fine of not less than $50 nor more than $250.
A. 
It shall be the duty of the Police Department of this City to enforce the provisions of this article. Officers of the Police Department are hereby authorized to direct all traffic, either in person or by means of visible or audible signal, in conformance with the provisions of the laws of New York State and of this article.
B. 
Emergency regulations. The Chief of Police is hereby empowered to make and enforce regulations necessary to make effective the provisions of this article and to make temporary regulations, effective for not to exceed 48 hours, to cover emergencies or special conditions, provided any such regulations are not inconsistent with the provisions of the laws of New York State or this article.
C. 
Obedience to police. It shall be unlawful for any person to refuse or fail to comply with any lawful order, signal or direction of a police officer.
D. 
The Chief of Police is hereby empowered and authorized to name a person or persons other than a police officer to enforce the parking regulations of the City of Middletown, New York, and the parking regulations of the State of New York.

A. 
The Common Council shall, by resolution, determine and designate the character or type of all official warning and directional signs and signals. Subject to this selection, the Chief of Police is hereby authorized, and as to these signs and signals required hereunder it shall be his duty, to place and maintain or cause to be placed and maintained all official traffic signs and signals. All signs and signals required hereunder for a particular purpose shall, as far as practicable, be uniform as to type and location throughout the City of Middletown.
B. 
Obedience to traffic signs and signals. It shall be unlawful for any driver of a vehicle to disobey the instructions of any official traffic sign or signal placed in accordance with the provisions of this article, unless otherwise directed by a traffic or police officer.
C. 
Crosswalks. The Chief of Police is hereby authorized to establish and designate and shall hereafter maintain or cause to be maintained by appropriate devices, marks or lines upon the surface of the roadway crosswalks at all intersections where, in his opinion, there is particular danger to pedestrians crossing the roadway and at such other places as he deems necessary.
D. 
Traffic lanes. The Chief of Police is also authorized to mark lanes for traffic on street pavements at such places as he may deem advisable, consistent with the provisions of this article.

A. 
Any person violating or causing to be violated any of the provisions of this article or amendments thereto shall be deemed guilty of a traffic infraction as defined by the Vehicle and Traffic Law of the State of New York and, upon conviction, unless otherwise provided, shall be punished as provided for in § 1800(b) of the Vehicle and Traffic Law of the State of New York.
B.

(3) 
Except for handicap parking tickets, the failure to enter a plea of guilty or not guilty within 10 days from the date of the violation shall result in a penalty assessment of $25 in addition to the amount of the fine. For all parking tickets, the failure to enter a plea of guilty or not guilty within 30 days from the date of the violation shall result in a penalty assessment of $10 in addition to the amount of the fine and earlier penalty assessment

C. 
The owner of any motorcycle, motor vehicle or vehicle violating any of the provisions of § 460-9 shall be subject to any of the penalties imposed by this Chapter 460. In addition to any other penalties imposed by this chapter for violations of Chapter 460 of the Code of the City of Middletown, any motorcycle, motor vehicle or vehicle violating any of the provisions of § 460-9 may be towed or removed or caused to be removed under the direction of the Police Department or the Commissioner of Public Works, without notice to the owner. A charge for such removal shall consist of the amount of all the expenses actually and necessarily incurred in effecting such removal. Such charges shall not exceed those charges described in § 440-6A of Chapter 440, Towing, in addition to any charges for storage. Such storage charges shall be in conformity with § 440-7 of Chapter 440, Towing, and such amount shall be charged to the owner or person in charge of the motorcycle, motor vehicle or vehicle upon payment to the City Treasurer or the garage owner to which the motorcycle, motor vehicle or vehicle has been moved for the full amount of expenses aforesaid.
