[Adopted 9-27-1965 (Ch. 118, Art. III of the 1971 Code)]
The following article providing for the establishing, maintenance, policing and supervision of parking lots in the City of Middletown, New York, shall be known and cited as the "Contract Parking Lot Ordinance of the City of Middletown, New York."
A. 
For the purpose of this article, the words "vehicle," "motor vehicle," "street," "highway," "operator" and "parking lot" shall have the respective meanings as defined in the Vehicle and Traffic Law of the State of New York.
B. 
As used in this article, the following terms shall have the meanings indicated:
CONTRACT PARKING
Parking for a duration of three months.
PARKING SPACE
Such parking spaces as are controlled by contract parking and are provided for the parking or standing of vehicles.
Contract parking in the following lots in the City of Middletown, New York, is hereby established; parking in said lots shall be limited to the duration and location prescribed and set forth in Article I of this chapter:
A. 
James Street, seven spaces formerly controlled by meters adjacent to the Erie Railroad Station.[2]

B. 
Municipal Lot 48-52, James Street (Gold Nugget Lot), 12 spaces for contract parking, the balance of parking in the lot for City-owned vehicles and City employees only.[3]

The duration of occupancy of parking in the lots designated in § 460-61 above shall be as prescribed and limited in the appropriate sections of Article I of this chapter. The aforesaid time limitations shall be applicable between the hours of 6:00 a.m. and 6:00 p.m. daily, except Sunday, in all zones designated in § 460-61.
The Police Department shall have lines or markings painted or placed upon the lots for the purpose of designating the parking space to be used, and each vehicle parking adjacent or next to any parking space shall park within the lines of markings so established. It shall be unlawful and a violation of this article to park any vehicle across any such line or markings or to park such vehicle in such a position that the same shall not be entirely within the area so designated by such lines or markings.

A. 
The following regulations concerning fees to be deposited with the Treasurer shall be applicable wherever contract parking shall be installed in the City of Middletown: When any vehicle shall occupy a parking space in a parking lot to which contract parking is designated in accordance with the provisions of this article, the operator of the vehicle shall purchase parking permits from the City Clerk at a cost of $10 monthly or $25 for each three-month period to be effective from April 1, 1991. There shall be no refunds.
B. 
Such periods shall be designated by the City Clerk.
For the purpose of this article, those sections of Article I of this chapter regulating and controlling overtime and illegal parking shall be and become a part of this article.

The Treasurer of the City of Middletown shall keep a complete record of all collections made from the contract parking lots and shall deposit such collections in the general fund of the City of Middletown.[1]

Every person convicted of a traffic infraction for a violation of any provision of this article which is not a violation of any provision of the Vehicle and Traffic Law of the State of New York shall for a first conviction thereof be punished by a fine of not more than $50 or by imprisonment for not more than 15 days, or by both such fine and imprisonment; for a second such conviction within 18 months thereafter, such person shall be punished by a fine of not more than $100 or by imprisonment of not more than 45 days, or by both such fine and imprisonment; upon a third or subsequent conviction within 18 months after the first conviction, such person shall be punished by a fine of not more than $250 or by imprisonment for not more than 90 days, or by both such fine and imprisonment.
This article shall be deemed to be in addition and supplementary to and not in conflict with or a repeal of prior or existing ordinances of the City of Middletown, except as hereinafter stated, but shall be an additional provision for the regulation of traffic and parking in those zones provided for herein.
In the event of a public emergency, the Mayor of the City of Middletown shall have the power to suspend the operation of the provisions of this article for the duration of such emergency.
