For the purpose of promoting the public health,
safety, and general welfare of the City of Middletown, the City is
hereby divided into the following types of districts:

The locations and boundaries of said districts are hereby established
as shown on the Zoning Map of the City of Middletown, New York, dated
February 2021. Said map, as may be amended, and all notations, references
and designations as shown thereon shall be as much a part of this
chapter as if the same were all fully described and set forth herein.
The fee for a copy of the zoning regulations shall be set in accordance
with the requirements of the New York Freedom of Information Law; the fee for a copy of the Zoning Map shall be $15.
Where uncertainty exists with respect to the
boundaries of any of the aforesaid districts as shown on the Zoning
Map, the following rules shall apply:
A. Where district boundaries are indicated as approximately
following the center lines of streets or highways, street lines or
highway right-of-way lines, such center lines, street lines or highway
right-of-way lines shall be construed to be such boundaries.
B. Where district boundaries are so indicated that they
approximately follow the lot lines, such lot lines shall be construed
to be said boundaries.
C. Where district boundaries are so indicated that they
are approximately parallel to the center lines or street lines of
streets, or the center lines or right-of-way lines of highways, such
district boundaries shall be construed as being parallel thereto and
at such distance therefrom as indicated on the Zoning Map. If no distance
is given, such dimension shall be determined by the use of the scale
shown on said Zoning Map.
D. Where the boundary of a district follows a railroad
line, such boundary shall be deemed to be located in the middle of
the main tracks of said railroad line.
E. Where the boundary of a district follows a stream,
lake or other body of water, said boundary line shall be deemed to
be at the limit of the jurisdiction of the City or following the center
line of the stream, lake or other body of water, unless otherwise
indicated.
