This article shall be known and may be cited as the "Park and
Public Property Ordinance of 2010."
For the purpose and within the meaning of this article, the
following definitions shall pertain:
The Township Manager or other employees or officials authorized
by the Board of Supervisors of the Township to administer and enforce
the provisions of this article.
Parks, park reservations, playgrounds, recreation centers,
swimming pools, golf courses, watersheds and all other areas of the
Township of East Hempfield devoted to active or passive recreation
by the public within the Township of East Hempfield.
All other lands owned by the Township of East Hempfield and
devoted to uses other than those listed above.

A.Â
All structures, equipment and facilities owned by the Township in
Park and Public Property are to be used in an appropriate fashion
for the activities for which they are designed and intended.
B.Â
It shall be unlawful for any person to do any of the acts hereinafter
described within the limits of any Township Park or Public Property:
(1)Â
To engage in any conduct which interferes with the peaceable use
of park or public property by other people, including but not limited
to the throwing of stones, sticks or hard objects in the vicinity
of other people and the use of lewd, vulgar or sexually suggestive
language or behavior in the presence of other people.
(2)Â
To permit any owner's dog, livestock or other pet or animal
under the owner's control to run at large. An owner is responsible
for cleaning up any waste from his or her animal and properly disposing
of it in containers provided for the same or in the owner's trash
collection receptacles.
(3)Â
To hunt for, shoot at, harass, catch, or intentionally injure or
kill or attempt to shoot at, harass, catch, or intentionally injure
or kill, with or without dogs, any bird or animal.
(4)Â
To commit any public nuisance.
(5)Â
To possess, drink, or be under the influence of malt or brewed beverages,
spirituous liquors or wine, except in areas of the Four Seasons Golf
Course designated for consumption of malt or brewed beverages, spirituous
liquors or wine, and provided same have been purchased on the premises
of the Four Seasons Golf Course.
(6)Â
To post or erect any bills, notices or advertising matter of any
kind without authorization, provided this shall not apply to notices
placed by employees of the Township engaged in the performance of
their duties, or to "issue signs" as defined and erected in accordance
with the provisions of the Zoning Ordinance[1] in appropriate areas at and immediately adjacent to the
Township offices at 1700 Nissley Road and the entrance drive thereto.
Such "issue" signs shall not be placed on or immediately adjacent
to lands meeting the definition of park above.

To sell or barter or offer for sale or barter any merchandise, article
or thing whatsoever without authorization, provided this shall not
apply to authorized concessionaires.
(8)Â
To have any musical, theatrical, or other entertainment therein without
authorization.
(9)Â
To discharge firearms, bows and arrows, air or spring rifles or slings,
except in authorized areas.
(10)Â
To swim, wade or bathe at any place except in a public swimming
or wading pool.
(11)Â
To injure, deface or destroy any posted or permanently fixed
signs or notices.
(12)Â
To break, cut, deface, disturb, injure or take any flower, fruit,
plant, tree, shrub, bench, building, fence, monument, or other structure,
apparatus or property.
(13)Â
To violate any posted rules for, or misuse any picnic area,
camp area, play field, swimming pool or other recreational area.
(14)Â
To gather or remove any wood, turf, grass, soil, rock, sand
or gravel.
(15)Â
To make or kindle fire except in picnic stoves or fireplaces
provided for that purpose.
(16)Â
To engage in camping, archery and hitting of golf balls, except
on such grounds or place specifically designated for such purpose.
(17)Â
To smoke in areas where prohibited by sign.
(18)Â
To discard tobacco or any tobacco by-products in any park area
or public property.
(19)Â
To throw or deposit cans, bottles, broken glass, paper or rubbish
of any description except in containers provided for the same.
(20)Â
To discard any dead animal or offensive matter or substance
of any kind.
(21)Â
To stand or park any vehicle except in those areas designated
therefor.
(22)Â
To congregate in any area which will hamper the free movement
of pedestrians.
(23)Â
To operate unlicensed motor vehicles.
(24)Â
To operate any vehicle or bicycle at any place other than roadways
or special areas designed for operation of such vehicles.
(25)Â
To use or operate skateboards or in-line skates on any structures
not designed for the same or for general pedestrian and vehicular
travel. Without limitation, the structures upon which skateboarding
or in-line skating is prohibited include those designed or used for
bocce ball, basketball, tennis and children's playground facilities
such as swings, climbing apparatus, seesaws, merry-go-rounds and similar
items.

To operate snowmobiles, mini-bikes, go-carts or any device which
utilizes burning fuel, explosive gas or compressed gas as a propellant
at any place except in authorized areas.
(27)Â
To wash, polish or repair any motor vehicle, except for emergency
repairs.
(28)Â
To abandon any vehicle within the limits of any park, public
property or roads abutting said park or public property.
(29)Â
To exceed a speed limit of 15 miles per hour, unless otherwise
posted, on all roadways, driveways, parking lots and other areas intended
for motorized vehicular traffic.

To permit any dog or other pet, whether on a leash or under
the control of the owner or otherwise, to be present, whether walking,
running or otherwise, upon the grounds of the Four Seasons Golf Course.

(31)Â
To enter or make use of the golf course area, including, without
limitation, all tee boxes, fairways, rough and hazard areas within
the inbounds area, greens and cart paths, of the Four Seasons Golf
Course property, unless participating in golf activities approved
by the golf pro or other person in charge of the golf shop as a playing
patron, or unless the person has received special permission from
the golf pro or other person in charge of the golf shop during times
when golf activities are not occurring or anticipated.

All public parks and playgrounds owned, operated, maintained
or supported by the Township of East Hempfield shall be closed between
the hours of sunset and sunrise. No person, other than authorized
supervisors, police, guards, or similar personnel, shall occupy, frequent
or use the parks and playgrounds between such hours, except when such
parks and playgrounds are being used for special events, entertainments,
athletic contests or similar affairs which have been authorized. In
such cases, the closing time of the park and playground where such
event is being held shall be 1/2 hour after the event has ended, but
no later than 12:00 midnight.

Whenever authorization is required by this article, such shall be
sought from the Township Manager or other employee or employees authorized
by the Board of Supervisors from time to time and shall be subject
to rules and regulations adopted from time to time. Any such authorization
shall be subject to such rules and regulations as fully as though
the same were inserted in the specific authorization granted to permit
the proposed use.

Any person or persons who have received such authorization, by reservation
or otherwise, shall be liable for any loss, damage or injury sustained
by any person or to any Township property by reason of the negligence
or intentional conduct of the person or persons to whom the authorization
was granted or by such person's agents, employees or invitees.
C.Â
It shall be unlawful for any person receiving authorization to use
the park or public property of the Township to make an alteration
to such authorization.
D.Â
Specific portions of this article or of any rules and regulations
adopted under it may be waived only upon written approval of the Board
of Supervisors.
E.Â
The Board of Supervisors may from time to time, by separate resolution,
establish reasonable fees and deposit arrangements for the use of
the parks and facilities therein and may adopt reasonable rules and
regulations consistent with the provisions of this article.
Any person who shall violate or fail to comply with the provisions
of this article or any regulations adopted by the Board thereunder
is guilty of a summary offense and upon conviction thereof shall before
a District Justice be sentenced to pay a fine of not less than $25
nor more than $300, together with costs of prosecution, and in default
of payment thereof shall be imprisoned for not more than 30 days.
This article shall become effective five days after adoption.
This article is intended as a modification and general restatement
of Ordinance No. 093-5, adopted December 29, 1993. Such ordinance
is repealed only to the extent that this article materially differs
from Ordinance 093-5.
