The Board of Trustees of the Incorporated Village of Sands Point (the "Board") hereby finds that it is in the interest of the welfare of the Incorporated Village of Sands Point (the "village") to shorten the current five-year term of office of the members of its Zoning Board of Appeals.
Pursuant to the village's municipal home rule powers, the Board is empowered to enact local laws in relation to the health, safety and welfare of persons or property in the village and in relation to the powers, duties, qualifications, number, mode of selection and removal and terms of office of the officers and employees.
It is the intent and purpose of this article to supersede § 7-712(4) of the Village Law in order to modify the term of office of members of the Zoning Board of Appeals from five years to three years.
The term of office of members of the Zoning Board of Appeals is established at three years.
Supersession of § 7-712(4) of the New York State Village Law. Pursuant to the authority set forth in Municipal Home Rule Law §§ 10[ii][a](1) and (12) and 10[ii][e](3), § 7-712(4) of the Village Law which, by its terms, effectively fixes as a five-year term of office for members of a five-member Zoning Boards of Appeals, as in Sands Point, is hereby superseded.
Terms of members now in office. Any Zoning Board of Appeals member currently holding office may continue to hold such office for the duration of his appointed term.
Terms affected. This article shall be applicable to all appointments, including reappointments, made on or after the effective date of this article.
