Sewer rents shall be used for deriving revenues
for financing and maintaining sewage collection and treatment facilities.
The funds derived from these rents shall be used for all municipal
expenses associated with constructing, improving or maintaining a
sewage system, including engineering, planning, construction, reconstruction
of sewers and all necessary appurtenances thereto, including pumping
stations, extensions, enlargement, replacement or additions to the
sanitary sewer systems or the preliminary or other studies and surveys
relative thereto and for the acquisition of land or rights-of-way
for any of the capital improvements.
A.
Sewer rents shall include a sewer-user charge and
a capital cost amortization charge to be levied on owners of properties
located within or without the Village boundaries who contribute sewage
to the public sewers.
B.
The following items shall be funded by the sewer rent
charge:
(1)
The cost of operation and maintenance of the entire
sewer collection system, including pump stations.
(2)
The cost of operation and maintenance of the sewage
treatment plant.
(3)
The cost of the retirement of the Village's portion
of the capital bonds and the interest thereon. This shall be the bond
issue less the proportional share of the Barclay Heights Sewer Improvement
Area or any other town district.
The semiannual sewer rent shall consist of a
minimum charge of $40.50 for the first 2,500 cubic feet of water consumed
and $1.62 for each additional 100 cubic feet of water consumed thereafter.
Sewer user charges shall be billed at the same
time that the Village of Saugerties' water bills for water usage charges
are billed. Capital costs amortization charges shall be billed at
the same time and included in the annual general Village tax statement
that is sent out by the Village.

In the event of a defective water meter, the average
of its last two quarterly billings for sewer rent charge during which
the meter was operating properly will be charged. In the event that
other than a residential class user enters and uses the improvement,
the method of computing the sewer rent charge for such user would
be based on factors such as strength, volume and delivery flow rate
characteristics, as well as the amount of water from the Saugerties
Water/Wastewater Department used by such user as set forth above.
If the property has its' own water supply or is served by an unmetered
independent water company, the owner shall have the option of installing
a water meter at his expense or the user charges shall be based on
100 gallons per person, per day. This shall mean that every man, woman
or child living in the residence shall be charged at that rate. Commercial
or nonresident users must install a water meter at their own expense.
The capital costs amortization charges shall be levied on the basis
of the assessed valuation of each parcel of property within the improvement
boundaries for general Village and County tax purposes at such rates
that may from time to time be set by the Village Board.
The bills for sewer rent charge shall become
due and payable to the Village of Saugerties Sewer Improvement Area,
and such payment shall be made to the Village Clerk, at its office.
If such bills are not paid within 30 days, a penalty of 10% of the
amount of such bill will be added thereto. If such bill remains unpaid
for 60 days, then interest at the rate of 2% per month on the unpaid
bill shall be added to the bill until payment is made. Sewer rent
charge and capital costs amortization charges, and the interest and
penalties thereon, shall be a lien upon the real property which is
using the public sewer or which is located within the improvement
boundaries, and on or before the day when, under the Village Law,
preliminary estimates of expenditures are required to be submitted,
the Village Clerk shall prepare and file with the Village Board a
statement showing all sewer rent charge with penalties and interest
thereon which remain unpaid, which said statement shall contain a
brief description of the property to which sewer services were supplied
or which is within the improvement boundaries, the name of the owner
liable to pay the same, so far as may be known, and the amount chargeable.
The Village of Saugerties shall require each property owner to make the tap on the public sewer and install the lateral from the main to the property line. There will be no connection charge but the property owner will be required to place a deposit of $300 to insure that the property owner's contractor adequately places and tests the lateral, properly backfills the trench, and repairs the street and sidewalk in accordance with Village requirements. Upon inspection and acceptance of the work, the Village shall return the deposit within 10 days of completion. All work on private property shall be performed by the property owner's contractor, but all work, whether in Village streets or private property, shall be inspected by the Village under § 151-14B of this chapter.
