For brevity and ease of communication, this
chapter may be cited as the "Town of Shandaken Sewer Use Law."
The general purpose of this chapter is the following:
To provide for efficient, economic, environmentally safe, and legal
operation of the Town of Shandaken publicly owned treatment works
(POTW) including the Shandaken wastewater treatment plant and sewage
collection system.
The specific purposes of this chapter are the
following:
A. To prevent the introduction of substances into the
municipal WWTP sewer system that will:
(1) Interfere with the municipal WWTP sewer system in
any way; or
(2) Pass through the municipal WWTP sewer system into
the state's waters and cause contravention of standards for those
waters or cause violation of the municipal WWTP sewer system's SPDES
permit; or
(3) Hamper the disposal of municipal WWTP sewer system
sludge and/or other residuals; or
(4) Endanger employees responsible for the operation,
maintenance, and repair of the municipal WWTP sewer system; or
(5) Cause air pollution or groundwater pollution, directly
or indirectly; or
(6) Cause, directly or indirectly, any public nuisance
condition.
B. To prevent new sources of infiltration and inflow
and, to the extent practicable, eliminate existing sources of infiltration
and inflow.
C. To assure that new sewer connections are properly
constructed.
Where this chapter references standards of design
or construction, such as but not limited to ASTM standards, ANSI standards,
and Ten State Standards, or NYCDEP, NYSDEC or US EPA regulation or
standards, such reference will be to the latest edition of any such
standard or regulation.
