These specifications are intended to provide adequate and uniform requirements for all subdivisions hereafter developed under the jurisdiction of the Planning Board the Town of Somers. They are intended as minimum standards and are supplementary to Chapter 150, Subdivision of Land, of the Code of the Town of Somers.
A.
The following specifications shall apply to all subdivision
roads hereafter constructed in the Town of Somers except as provided for herein
and with the following exceptions:
(1)
Roads specifically required to be of a higher quality
by the Planning Board or Town Board.
(2)
Roads of higher quality offered by the road builder and
acceptable to the Superintendent of Highways and the Town Engineer.
(3)
The Planning Board may modify or waive, upon the request
of the applicant and subject to appropriate conditions, the provision of any
or all such improvements as, in its judgment of the special circumstances
of a particular subdivision plat, are not requisite in the interest of the
public health, safety and general welfare or which are inappropriate because
of the inadequacy or lack of connecting facilities adjacent to or in proximity
to the subdivision.
B.
These road specifications are not intended to cover every
detail of construction but are adopted to indicate acceptable standards of
material, workmanship and construction in a general manner.
C.
The subdivider shall observe the following construction
standards and specifications in subdivisions.
D.
If, in the course of construction, special conditions
are encountered, such as floods, underground water, humus beds, quicksand
or other unusual circumstances unforeseen in the original planning, the subdivider
may request of the Town Engineer a special treatment to secure adequate and
permanent construction. Such special treatment to secure the same shall be
proposed by a professional engineer retained by the subdivider. The Town Engineer
shall:

Approval of a road constructed in accordance with these
specifications does not obligate the town to accept such road as a town road.
A.
All materials and/or methods of construction not described
in these standards shall meet the requirements of the current specifications
of the New York State Department of Transportation.
B.
The specifications of this chapter are not illustrated.
However, the construction details, if accepted by the Planning Board, shall
be made part of the specifications herewith.
C.
Before any work described herein is undertaken, at least
48 hours' notice shall be given to the Town Engineer. None of the operations
required herein shall be backfilled, covered or succeeded by a subsequent
operation until approval is rendered by the Town Engineer's office as required.
Work performed not in accordance with these provisions may not be accepted
except for good cause shown.
A.
In these specifications certain words and terms are used
which require definition and limitation in order to avoid misinterpretation
and uncertainty. All words not otherwise defined shall be assumed to have
their normal dictionary meanings. Technical terminology not otherwise defined
shall be assumed to have the meaning commonly accepted in engineering, construction
or other technical practice.

As used in these specifications, the following terms
shall have the meanings indicated:
The approved detail sheets accompanying the construction plans for
an approved subdivision or site plan on file at the Town of Somers Department
of Planning and Engineering.
The maps or drawings accompanying a subdivision plat or site plan
and showing the specific location and design of improvements to be installed
in the subdivision.
The agent of the subdivider in performing the work governed by these
specifications.
A surveyor's concrete marker installed on the right-of-way line as
shown on the filed subdivision plat.
The Planning Board of the Town of Somers.
Includes streets, roadways and highways to designate areas for vehicular
travel and shall include private roads.
The independent contractor hired by the Town Board to assist the
Town Engineer with field inspections.
A person, firm or corporation or other entity who plans or is creating
a subdivision.
The division of a tract or parcel of land into two or more parts
or lots for the purpose, whether immediate or future, of transfer of ownership
or building development.
The Town of Somers, New York.
The agent of the town representing the Town Board and/or the Planning
Board.
The Town Board of the Town of Somers.
The registered engineer authorized by the Planning Board to make
technical field decisions.
That portion of a road surface prepared for vehicle use (pavement).
All lands and water within the confines of a drainage divide.
