Town of Thompson, NY Article II General Provisions

§ 231-7 Definitions.

The words and phrases used in this Part 2 shall, for the purposes of this Part 2, have the meanings respectively ascribed to them by Article I of the Vehicle and Traffic Law of the State of New York.

§ 231-8 Authority to install traffic control devices.

The Town Highway Superintendent shall install and maintain traffic control devices when and as required under the provisions of this Part 2 to make effective the provisions of this Part 2 and may install and maintain such additional traffic control devices as the Town Board may deem necessary to regulate, warn or guide traffic under the Vehicle and Traffic Law of the State of New York, subject to the provisions of §§ 1682 and 1684 of that law.

§ 231-9 Highway markings.

The system of traffic markings upon the New York State highways is hereby made applicable to the Town roads in the Town of Thompson. Said markings when placed upon Town roads shall have the same meaning and effect as similar markings upon state roads in this Town, and violations of such markings upon said Town roads shall be subject to the same penalties as violations of such markings on state roads.

§ 231-10 Implementation of provisions.

The provisions of this Part 2 shall be implemented by the adoption of regulations by the Town Board or an officer or agency authorized by it pursuant to § 1603 of the Vehicle and Traffic Law. Such regulations shall designate the specific area within which the provisions of this Part 2 shall be in effect by reference to the appropriate schedule established by this Part 2 for the recording of such regulations. Such schedules shall be attached to and form a part of this Part 2, and a violation of any regulation contained in said schedules shall be deemed a violation of this Part 2.

§ 231-11 Penalties for offenses.

A. Every person convicted of a traffic infraction for a violation of any provision of this Part 2, with the exception of all parking, standing and stopping infractions under Article IV of this Part 2, shall be subject to a penalty as provided in § 1800 of the Vehicle and Traffic Law.

B. Every person convicted of a parking, standing and stopping infraction pursuant to Article IV shall be subject to the following fine and penalty schedule:

(1) For violation of Town Code § 231-24, the fine shall be $75;

(2) For violation of Town Code § 231-25, the fine shall be $100;

(3) For violation of Town Code § 231-26, the fine shall be $125.

(4) For violation of Town Code §§ 231-27 and 231-28, the fine shall be $75;

(5) For violation of Town Code § 231-29, the fine shall be $75;

(6) For violation of Town Code § 231-30, the fine shall be $75;

(7) For violation of Town Code § 231-31, the fine shall be $75;

(8) For violation of Town Code § 231-32, the fine shall be $75;

(9) For violation of Town Code §§ 231-33 and 231-34, the fine shall be $75;

(10) For violation of Town Code § 231-35, the fine shall be $200;

(11) For violation of Town Code § 231-47, the fine shall be $150;

(12) For other nonenumerated parking violations, the fine shall be $150.

§ 231-12 When effective.

A. Except those parts, if any, which are subject to approval under § 1684 of the Vehicle and Traffic Law of the State of New York, this Part 2 and any orders, rules and/or regulations adopted and/or issued hereunder shall take effect as provided by law.

B. Any part or parts of this Part 2 and any orders, rules and/or regulations adopted and/or issued hereunder which are subject to approval under § 1684 of the Vehicle and Traffic Law of the State of New York shall take effect from and after the day on which approval, in writing, is received from the New York State Department of Transportation.
