It is the intent of this chapter to license,
regulate and restrict hawking, vending, peddling, soliciting orders
and the crying of goods, wares, merchandise or other commodities in
the streets and public places and by going from house to house, by
person or persons
As used in this chapter, the following terms
shall have the meanings indicated:
PERSON
One or more persons of either sex, natural persons, corporations,
partnerships, associations, joint-stock companies, societies and all
other entities capable of being sued.
No person shall publicly hawk, vend, peddle,
solicit orders and/or cry goods, wares, merchandise or other commodities
in the streets and public places and by going from house to house
in any part of the Village of Tivoli, New York, either on foot or
with a vehicle or any other conveyance, without first obtaining a
license therefor as hereinafter provided, but nothing herein contained
shall apply to sales made to merchants for retail trade, or to sales
made to any person or persons of farm produce, if such produce is
peddled and sold by the producer thereof or his servants or employees,
or to persons selling newspapers or periodicals. The term "farm produce"
shall not include nursery stock, potted plants or cut flowers.

Applications for hawking and peddling licenses
shall be made by the applicant in person to the Village Clerk of the
Village of Tivoli, New York, and after approval of said application,
the Village Clerk is authorized to issue such license, upon receiving
the license fees as set forth, from time to time, by resolution of
the Board of Trustees. The Village Clerk is authorized and directed to collect
such rates.
Any person or persons having obtained a license
under the provisions of this chapter shall carry such license with
him while peddling or hawking in said Village.
All licenses issued under this chapter shall
terminate on the 31st day of December thereafter.

Any person, firm or corporation who shall violate
any of the provisions of this chapter shall, upon conviction, be punishable
by a fine of not more than $250 or imprisonment for not more than
15 days, or both. Each day of continuance of an offense shall be considered
a separate offense.
