This chapter shall be known and cited as "Breach of Peace."
The purpose of this chapter is to protect the safety, health and welfare
of the residents of the Village of Weedsport, Cayuga County, New York.
As used in this chapter, the following terms shall have the meanings
indicated:
A place to which the public or a substantial group of persons has
access and includes but is not limited to highways, transportation facilities,
schools, places of amusement, parks, playgrounds and hallways, lobbies and
other portions of apartment houses and hotels not constituting rooms or apartments
designed for actual residence, restaurants, taverns, businesses and any and
all facilities, indoor or outdoor, holding themselves open for use by the
public.
A person is guilty of breach of the peace when:
A.
He engages in fighting or violent, tumultuous or threatening
behavior.
B.
He makes unreasonable noise.
C.
He causes public inconvenience, annoyance or alarm or
recklessly creates a risk thereof.
D.
In a public place, he uses abusive or obscene language
or makes an obscene gesture.
E.
Without lawful authority, he disturbs a lawful assembly
or meeting of persons.
F.
He obstructs vehicular or pedestrian traffic.
G.
He congregates with other persons in a public place and
refuses to comply with a lawful order of the police to disburse.
I.
He challenges or provokes another to fight.
J.
He threatens personal violence to another person.
K.
He assists in any manner whatsoever or encourages any
fight or similar behavior.
L.
He harasses, annoys or alarms another person.
Breach of the peace is a violation.
