A. 
Under the provisions of § 243 of the General Municipal Law of the State of New York, there is hereby established a Recreation Commission.
B. 
This Commission shall consist of seven persons serving without pay, four of whom shall be appointed by the Village of Westfield Board of Trustees and three of whom shall be appointed by the Town Board of the Town of Westfield.

C. 
The term of office shall be for three years or until their successors are appointed and qualified, except that the members of such Commission first appointed shall be appointed for such terms that the term of one member from each Board shall expire annually thereafter.

D. 
Vacancies in such Commission occurring otherwise than by expiration of a term shall be filled by the Village of Westfield Board of Trustees or the Town Board of the Town of Westfield, according to the original appointment.

Immediately after their appointment, they shall meet and organize by electing one of their members as Chairman and such other officers as may be necessary. The Commission shall have the power to adopt bylaws, rules and regulations for the proper conduct of public recreation for the Town and Village of Westfield, such rules and regulations to be approved by the Board of Trustees and the Town Board of Westfield.
The Commission shall provide, conduct and supervise public playgrounds, athletic fields, recreation centers and other recreation facilities and activities on any of the properties owned or controlled by the town or Village with the approval of the Board of Trustees or the Town Board, as the case may be, or on other properties with the consent of the owners and authorities thereof. It shall have the power to conduct any form of recreation or cultural activity that will employ the leisure time of the people in a constructive and wholesome manner, subject to the approval of the Board of Trustees and the Town Board.

The Village Board of Trustees shall have the power to appoint or designate someone to act as Director of Recreation who is trained and properly qualified for the work and such other personnel as the Village Board of Trustees deems proper.

Annually, the Recreation Commission shall submit a budget to the town and Village governing bodies for their approval. The Commission may also solicit or receive any gifts or bequests of money or other personal property or any donation to be applied, principal or income, for either temporary or permanent use for playgrounds or other recreational purposes. Any gifts or bequests shall be turned over to the Village Treasurer within five days of receipt of the same.
The Commission shall make full and complete annual reports to the respective governing bodies of the town and Village and other reports from time to time as requested.
