It shall be lawful for authorized organizations, upon obtaining a license therefor to conduct only the types of games of chance listed herein, within the boundaries of the Village of Westfield, under the provisions of this chapter, the provisions of Article 9-A of the General Municipal Law, and the rules and regulations of the New York State Racing and Wagering Board adopted or to be adopted. Only the following games of chance, as defined in 9 NYCRR 5620 of the rules and regulations of the New York State Racing and Wagering Board, may be licensed to be conducted in this Village: bell jar, big six and merchandise wheels.

The provisions of the Games of Chance Licensing Law[1] and the rules and regulations of the New York State Racing and Wagering Board control the licensing of authorized organizations and the conduct of games of chance in the Village of Westfield, New York, and this chapter incorporate the provisions of those statutes and regulations by reference as if fully set forth herein. Any inconsistency between this chapter and said statutes and rules and regulations shall be resolved in favor of that statute and those rules and regulations.

The Village Clerk is authorized to issue licenses to authorized organizations and lessors upon filing of an application in accordance with the provisions of the Games of Chance Licensing Law, the rules and regulations of the New York State Racing and Wagering Board and the restrictions of the Village of Westfield herein set out and upon the payment of the prescribed fees. No premises or property of the Village of Westfield, including the Village of Westfield Fire Department station(s), shall be used or licensed for the conduct of games of chance, except:
A. 
The Fire Department station may be used on one occasion during and in connection with the annual Ham Party, a pre-Easter event, and on one occasion during and in connection with the annual Turkey Party, a pre-Thanksgiving Day event; and
B. 
Ottaway Park may be used on one occasion during and in connection with the annual Ox Roast, held either on the first or second Sunday in July following the Fourth of July.
The Village Clerk is directed to remit to the Village Treasurer all license fees received by the Village Clerk, and the Treasurer is directed to remit to the Comptroller of the State of New York the portion of the fees directed to be paid and remitted to the Comptroller of the State of New York in the manner described in the Games of Chance Licensing Law.[1]

The conduct of games of chance on Sundays is authorized except as otherwise provided in Article 9-A of the General Municipal Law of the State of New York.
