In this chapter "shall" or "will" is mandatory; "may" is permissive.
The authorities for this chapter shall be as follows:
A. 
Board of Public Utilities (BPU). The BPU is the Village water supplier and is authorized and responsible to manage the Village water system and service.
B. 
Water supply. The State of New York Department of Conservation, Water Power and Control Commission, Water Supply Application No. 979, approved September 30, 1935.
C. 
New York State Sanitary Regulations.
A. 
Violation notice. Any person found to be violating any provision of this chapter, except § 150-17, shall be served by the Village with written notice stating the nature of the violation and providing a reasonable time limit for satisfactory correction thereof. The offender shall, within the period of time stated in such notice, permanently cease all violations.
B. 
Penalties for offenses. Any person who shall continue any violation beyond the time limit provided for in § 150-3A shall be guilty of a misdemeanor and, upon conviction thereof, shall be fined in the amount not exceeding $5,000 for each violation. Each day in which any violation shall continue shall be deemed a separate offense.
C. 
Damage to structures or equipment unlawful. Any person who shall break, damage, destroy, uncover, deface or tamper with any structure, appurtenance, fence or equipment which is a part of the water supply works shall be charged with an offense under Article 145 of the Penal Law and, upon conviction, shall be subject to the fine and imprisonment, or both, for the particular offense charged. Each day's commission of the offense shall constitute a separate offense.
A. 
As used in this chapter, the following terms shall have the meanings indicated:
BASE RATE
The rates prescribed for minimum water use and the first subsequent use block for each category of water supply service.
BPU
Village of Westfield Board of Public Utilities, its employees or designees.
CONSECUTIVE WATER SYSTEM
A public water system with one or more successive public water systems which have been approved by the state to be monitored for water quality as a single system under the State Sanitary Code.
CURB VALVE
A water supply valve placed on or adjacent to a property to which the water service pipe for the property is attached.
EMERGENCY REPAIR
Any broken water line, or system, or component thereof that serves as an immediate danger to the life, safety, health or welfare of any person as a result of such breakage or deficient component shall be deemed an emergency, and emergency repairs shall be hereby authorized.

INDIVIDUAL CUSTOMER
One who does not own or operate a public water system serving others.
PRIVATE WATER SYSTEM
A water system which serves fewer than five structures containing a structure, or serving fewer than 25 persons daily 60 or more days each year.
PUBLIC WATER SYSTEM SUPPLIER
The owner or operator of a water system which serves five or more structures containing a multiple residence, or serving 25 or more persons daily 60 or more days each year.
SERVICE LINE
The piping or water service line for conducting water from a water main to the water distribution system of the structure served.
STANDARD ENGINEERING PRACTICE
Meeting or exceeding the applicable design, materials and construction standards in keeping with government regulations, engineering association standards, general engineering practice and industrial and trade standards.
STRUCTURE
Any building, premises or residence that is served by a municipal or private water system.
SUCCESSIVE PUBLIC WATER SYSTEM
A public water system supplied with water by the Village system.
SUPERINTENDENT
The Water and Sewer Superintendent of the Village of Westfield or his authorized deputy, agent or representative.
WATER DEPARTMENT
The Village of Westfield Water and Sewer Department or any authorized employee or contractor of the Village of Westfield Water and Sewer Department.
WATER MAIN or MAIN
A water main in a public street or right-of-way owned by a municipality or public organization and supplying or capable of supplying water to more than one parcel of property.
WATER SYSTEM OPERATION
The operation of a public water system as prescribed by Part 5 of the New York State Sanitary Code to include all responsibilities of a certified operator.

All other definitions of Part 5 of the New York State Sanitary Code are applicable to this agreement.
