Pursuant to the authority conferred by § 7-700
of the Village Law of the State of New York, the Board of Trustees
of the Village of Westfield, New York, hereby adopts and enacts as
follows.
This chapter shall be known and shall be cited
as the "Village of Westfield Zoning Law."
The provisions of this chapter shall be held
to be the minimum requirements adopted to promote the health, safety
and general welfare of the Village of Westfield. These regulations
are intended to achieve the following purposes:
A. To encourage the most appropriate use of the land.
B. To balance the rights of the public-at-large, private
landowners and other various interest groups.
C. To encourage the beneficial shaping of the future
and long-range advantages associated with zoning laws.
D. To secure safety from fire, flood and other dangers
by the controlling of building heights and separation of structures
and through other beneficial regulations.
E. To provide adequate light, air and privacy.
F. To facilitate the adequate provisions for public utilities
and facilities.
G. To prevent the overcrowding and undue concentration
of people.
H. To regulate the location, use and occupancy of buildings
and the use of land for trade, industry, residence and other uses.
I. To maintain the character of residential neighborhoods
so as to promote residential family life through the appropriate designation
of uses within zoning districts.
J. To optimally utilize existing roadways and discourage
the construction of new roads, except as needed.
K. To regulate and determine the physical dimensions
of buildings and other structures.
L. To regulate and determine the area of yards and other
open spaces.
M. To encourage the retention of prime agricultural,
commercial and residential properties in those uses to which they
are best suited.
N. To protect property values and individual investment
by encouraging development appropriate to each zoning district type.
O. To protect the aesthetic nature of property.
P. To provide for the enforcement and administration
of this chapter and penalties for the violation of its provisions.
