[Amended 4-3-2008 by L.L. No. 1-2008; 7-15-2019 by L.L. No. 1-2019]
The boundaries of the zoning districts enumerated in §
155-7 of this chapter are hereby established as shown on the map entitled "Zoning District Map of the Village of Westfield, dated July 15, 2019," which, with all explanatory matters thereon, is made a part of this chapter.
Where uncertainty exists with respect to the
boundary of any district as shown on the Village of Westfield Zoning
Map, the following rules shall apply:
A. Where district boundaries are indicated as approximately
following the center lines of streets and highways, the street lines
or highway right-of-way lines shall be construed to be such boundaries.
B. Where district boundaries are indicated as following
enumerated lot lines, such lot lines shall constitute said boundaries.
C. Where district boundaries are so indicated as to approximately
parallel the center lines or street lines of streets or the center
lines or right-of-way lines of highways, such district boundaries
shall be construed as being parallel thereto, and at such distances
as are indicated upon the Village of Westfield Zoning Map or as shall
be determined by use of the scale supplied upon the map.
D. Where the district boundary follows a stream, lake
or other body of water, said boundary line shall be deemed at the
limit the jurisdiction of the municipality, unless otherwise indicated.
E. Any flood boundary shown upon the Zoning Map indicates
general location only. The precise location of floodplain boundaries
shall be established by the Enforcement Officer after reference to
Floodplain Zoning Maps and consultation with the Chautauqua County
Planning Division for its proper interpretation.
F. Where uncertainty exists in determining the precise
location of any district boundary line, the Zoning Board of Appeals
shall interpret the intent and purpose of the Zoning Map.
When a district boundary line divides a lot,
the regulations for either district may apply not more than 25 feet
beyond the boundary line of the district upon approval of the Zoning
Board of Appeals.
