The purpose of this chapter is to provide for the defense and indemnification
of Town employees pursuant to § 18 of the Public Officers Law.
As used in this chapter, the following terms shall have the meanings
indicated:
The Town of Wheatfield.
Any member of a public board or commission or an officer, employee,
volunteer expressly authorized to participate in a publicly sponsored volunteer
program or any other person holding a position by election, appointment or
employment in the service of the Town of Wheatfield. The term "Town employee"
shall not include an independent contractor. The term "Town employee" shall
include a former employee, the employee's estate or a judicially appointed
personal representative.
The Town of Wheatfield hereby confers the benefits of § 18
of the Public Officers Law upon its employees, subject to the limitations
set forth in said § 18.
The Town of Wheatfield hereby agrees to be held liable for the costs
incurred under § 18 of the Public Officers Law, subject to the limitations
set forth in said § 18.
