This article shall be known as the "Snowplowing and Removal Law of the
Town of Wheatfield, New York."
The purpose of this article shall be to protect and promote the health,
safety and welfare of the people of the Town of Wheatfield, New York, and
those using the highways and roads within the Town of Wheatfield by controlling
the plowing, shoveling or heaping of snow within the Town of Wheatfield.
No person shall plow, shovel or heap snow or ice into piles or ridges
or cause such plowing, shoveling or heaping to be done so as to interfere
with the public travel or prevent the safe approach to a residence or place
of business. When snow or ice is plowed, shoveled, brushed, swept or blown
about, it shall be removed from any public street, crosswalk or public place
and from any property not owned by that person plowing, shoveling, brushing,
sweeping or moving it about.
No plow, sweeper or rotary brush shall be used within the Town of Wheatfield
unless it is protected to prevent the throwing of any snow or ice upon pedestrians
or motor vehicles.
Snowplowing, snow removal and protection against ice on public roadways
within the Town of Wheatfield and under the supervision and control of the
Town of Wheatfield shall be the duty of the Town of Wheatfield Highway Superintendent.
Any person who shall have violated or failed to comply with the provisions
of this article shall, in addition to any fine prescribed for by a Town Justice
of the Town of Wheatfield, also be liable for and subject to pay the cost
of any expenses incurred by the Town of Wheatfield in the removal of snow,
ice or other material made necessary by the same having been plowed, shoveled,
brushed, swept, heaped or moved about by such person and left unremoved in
violation of the provisions of this article and be subject to a fine not to
exceed $250 or imprisonment not to exceed 15 days, or both such fine and imprisonment.
