It shall be unlawful for any person, firm or corporation to place or permit to be placed or to let or leave on the streets, alleys, curbs or sidewalks of the Borough of Greencastle, Pennsylvania, any dirt, mud, stone, sand, slag, cinders or other solid material, or any oil, chemical or other liquid material, except water. This article shall not prevent the placing of stone, sand, slag, cinders, salt or chemicals on streets, alleys or sidewalks during periods of snow or ice for control of snow or ice, nor the use of road building materials in the construction, reconstruction or repair of streets or alleys.

A. 
Any person who shall violate any provision of this article shall, upon conviction thereof, be sentenced to pay a fine not more than $300; and/or to imprisonment for a term not to exceed 90 days. Each day that a violation continues shall constitute a separate offense.
B. 
If more than one person, firm or corporation is engaged in any construction project or undertaking, the aforesaid written warning shall be given only to the general contractor on said project or undertaking, after which any violation of this article by any subcontractor or supplier shall be deemed a violation subject to the penalties set forth herein.
In addition to the foregoing penalty, the Mayor and Borough Council of the Borough of Greencastle, Pennsylvania, shall have the right to collect from any person, firm or corporation violating the provisions of this article all costs of restoring the street, alley, curb or sidewalk to their or its conditions immediately previous to the placing of the foreign substance thereon, whether said substance is placed thereon before or after the aforesaid written warning.
