Editor's Note: This ordinance also repealed former Ch. 74, Building Construction, adopted 11-28-1994 by Ord. No. 94-2, and served as a correction of Ord. No. 98-1, adopted 4-27-1998, which ordinance was never codified per instruction of the Borough.
A certain document, copies of which are on file in the offices of the Borough of Jenkintown, being marked and designated as the "BOCA National Building Code, Fourteenth Edition, 1999," be and is hereby adopted as the Building Code of the Borough of Jenkintown in the State of Pennsylvania, for the control of buildings and structures as herein provided; and each and all of the regulations, provisions, penalties, conditions and terms of said BOCA National Building Code are hereby referred to, adopted and made a part hereof as if fully set out in this article, with the additions, insertions, deletions and changes, if any, prescribed in § 74-2 of this article.
The following sections are hereby revised as follows:
A. 
In Section 101.1 (page 1), insert "Borough of Jenkintown."
B. 
In Section 112.3.1 (page 5), insert "as adopted by resolution."
C. 
Amend Section 116.4 (page 6) as follows:
116.4 Violation penalties: Any person who shall violate a provision of the BOCA National Building Code, 1999, or fail to comply with any of the requirements thereof or who shall erect, construct, alter or repair a building or structure in violation of an approved plan or directive of a building official or of a permit or certificate issued under the provisions of the BOCA National Building Code, 1999, shall be liable, on conviction thereof, to a penalty not exceeding $1,000 or imprisonment for a period not exceeding 30 days, or both, for each and every offense, and whenever such offense occurs and whenever such person shall have been notified by the Building Inspector by service of a summons in a prosecution, or in any other way, that he has committed such violation of this chapter, each day that he shall continue such violation after such notification shall constitute a separate offense, punishable by a like fine or penalty. Such fines or penalties shall be collected as fines and penalties are now by law collected.
D. 
Add new Section 116.5 as follows:
116.5 Imposition of double fines: Any contractor, resident, owner, business owner or other entity who starts work without having been granted the proper construction permits from the Borough of Jenkintown will be fined double the original permit fees.
E. 
Add new Section 116.6 as follows:
116.6 Technical permits: No technical permits shall be issued until all prior approvals and technical applications have been submitted and approved.
F. 
In Section 117.2 (page 6), insert dollar amounts in two locations: less than "$100" nor more than "$1,000."
G. 
Section 121.2.1 is deleted in its entirety.
H. 
Add new Section 310.5.2 as follows:
310.5.2 Multiple single-family dwellings: Multiple single-family dwellings must have a two-foot offset between adjacent units. Exceptions:
1.
The exterior walls are rated one hour for a distance of four feet from where the dwelling meets.
2.
A two-foot masonry wing wall extends past the face of the dwelling units where they have a common wall.
3.
The entire building is protected by an automatic fire suppression system.

Exception: Buildings equipped throughout with an automatic fire suppression system that is monitored by an audible alarm and a central station.

707.7 Combustible framing: There shall be no combustible framing allowed in any firewall.

1601.1.2 Residential attics: A live load shall be applied to joists or to bottom chords of trusses or trussed rafters only in those portions of attic space having a clear height of 42 inches (1067 mm) or more between joist and rafter in conventional rafter construction and between bottom chord and any other member in trusses or trussed rafter construction. A ceiling live load reduction to 20 pounds per square foot is permitted in areas under 42 inches' clearance between rafters and ceiling joists.
X. 
Add Section 1806.1.1 as follows:
1806.1.1 Minimum depth: Minimum depth of footings shall be 36 inches from finished grade.
Y. 
Amend Section 1810.6 as follows:
1810.6 Forming of concrete: Concrete footings shall not be cast against the earth. Forming shall be in accordance with Chapter 6 of ACI 318, listed in Chapter 35.
Z. 
Amend Section 1812.3 as follows:
1812.3 Minimum thickness: Minimum thickness of basement foundation walls shall be twelve-inch block or eight-inch poured concrete.
AA. 
Add Section 2301.1.1 as follows:
2301.1.1 Minimum lumber grade: Minimum lumber grade for any structural member shall be No. 2, as certified by the Western Wood Association.
BB. 
Amend Section 2305.13 as follows:
2305.13 Wall sheathing: Except as provided for in Section 1405.3 for wallboard or where stucco construction that complies with Section 2506.0 is installed, all enclosed buildings shall be sheathed with one of the materials of the nominal thickness specified in Table 2305.13.
CC. 
In Table 2305.13, delete "gypsum sheathing" and "gypsum wallboard."
DD. 
In Section 2308.4, rewrite last sentence as follows: "Minimum sheathing over 16 inch on center (OC) is as follows:

In Section 3408.2, Applicability, insert the date that the 1999 BOCA Building Code is adopted.
The CABO One- and Two-Family Dwelling Code, 1995 Edition, second printing, and the 1996/1997 amendments as published by the Council of American Building Officials.
This article shall regulate the fabrication, erection, construction, enlargement, alteration, repair, location and use of detached one- and two-family dwellings, their appurtenances and accessory structures in the jurisdiction of the Borough of Jenkintown and provide for the issuance of permits therefor and provide penalties for the violations thereof.
