On or after the passage of this article, it shall be unlawful for any person to carry on or work at the business of plumbing or house drainage in the Borough of Jenkintown until a license to engage in or work at said business shall have been granted to said person by the Borough of Jenkintown. Said license shall be issued upon registration in the office of the Borough Manager of said Borough as herein provided. Nothing in this article shall be construed to prevent the employment of journeyman or apprentice plumbers under the direction and supervision of a duly registered and licensed master plumber.
A. 
Registration of master plumbers. All master plumbers duly registered and currently licensed in a Pennsylvania municipality, the examination and licensing requirements of which are satisfactory to the Borough Manager, shall not be required to undergo any examination, and they shall be entitled to register for the current year and annually thereafter before the 31st day of December of each year.
B. 
Registration of journeyman plumbers. All journeyman plumbers duly registered and currently licensed to work as such at the business of plumbing and house drainage in a Pennsylvania municipality, the examination and licensing requirements of which are satisfactory to the Borough Manager, shall not be required to undergo any examination, and they shall be entitled to register for the current year and annually thereafter before the 31st day of December of each year.
A. 
Initial license registration fee. Any master plumber engaged or engaging in the business of plumbing or house drainage in the Borough of Jenkintown and any journeyman plumber working at the business of plumbing or house drainage in the Borough of Jenkintown shall pay for an initial registration a fee which shall be fixed from time to time by a resolution of the Borough Council.
B. 
Expiration of licenses. At the expiration of each calendar year, said license shall be null and void. A licensed master or journeyman plumber desiring to continue in or work at the business of plumbing and house drainage for the ensuing year shall, before the 31st day of December of each year, surrender said license for the current year to the Borough Manager and reregister his, their, her or its name or names and business or home address upon such form or forms as may from time to time be furnished by the Borough Manager.
C. 
License reregistration fee. Unless the licensed master plumber or journeyman plumber shall have failed to make application for reregistration on or before the 31st day of December, master plumbers and journeyman plumbers shall be reregistered upon surrender of a license for the current year and the payment of a reregistration fee which shall be fixed from time to time by a resolution of the Borough Council. The reregistration fee for all applications for reregistration received after December 31 shall be the same fee as is charged for an initial registration.
D. 
Registration as institutional plumber. A person who is currently registered as a master plumber in a Pennsylvania municipality, the examination and licensing requirements of which are satisfactory to the Borough Manager, may be registered as an institutional plumber for the care, alteration or addition of or to the drainage system of a designated manufacturing or mercantile establishment, institution, hotel, apartment building or similar establishment where it is necessary to have the continual services of a qualified plumber. An institutional plumber shall be subject to all the licensing and registration requirements to which a master plumber is subject. In no case shall an institutional plumber be permitted to do any plumbing or drainage work in any building or buildings other than those for which he/she is registered. To obtain a registration other than as an institutional master plumber, the person must submit proof that he/she is no longer employed by said manufacturing or mercantile establishment, institution, hotel, apartment house or similar establishment and must offer evidence of a bona fide place of business.
E. 
Licenses may be revoked.
(1) 
The license granted under this article may be suspended or revoked by the Borough Manager when a master plumber, firm or corporation, or the registered representative thereof, shall violate any rules or regulation of Chapter 137, Plumbing, of this Code; shall refuse or neglect to make the necessary corrections to work not approved by the Borough within a reasonable time after notification thereof; or shall permit the use of his, her, their or its name by a person or persons for the purpose of obtaining a permit or permits to do plumbing or drainage work.
(2) 
No person or corporation carrying on the business of plumbing and house drainage shall allow his, her or its name to be used by any person, directly or indirectly, either to obtain the permit or permits or to do any work under his, her or its license.
A. 
Display of signs. Every master plumber doing work in the Borough of Jenkintown must have his/her truck or trucks clearly lettered with the name and address of his/her business.
B. 
Notice of change of place of business.
(1) 
Every registered master plumber, firm or corporation shall give immediate notice of any change in his, her, their or its place of business, and upon his, her, their or its retirement from business or upon his, her, their or its failure to continue to actively engage in the business of plumbing, shall surrender the certificate of registry to the Borough Manager.
(2) 
Every person registering for any firm or corporation shall give the full name or names of the person or firm or the names of the officers of the corporation for which he/she shall register.
A. 
Any person or persons, firm or corporation who or which shall fail to comply with any of the provisions of this article regarding the procuring of a license or certificate to engage in or work at the business of plumbing or house or building drainage shall be guilty of a summary offense and liable, upon conviction, to a fine of not less than $25 nor more than $600 or imprisonment for not more than 90 days, or both, for each and every day he, she, they or it shall engage in or work at said business without first having obtained said certificate, license or registration, in the discretion of the Magisterial District Judge, together with costs of prosecution in each case. Any person or persons, firm or corporation who or which shall violate any of the approved rules and regulations of the Borough of Jenkintown regarding the construction, reconstruction, testing or removal of plumbing, house and building drainage or water connections to private or public fixtures or equipment shall be liable, upon conviction for the offense, to a fine of not less than $25 nor more than $600 or imprisonment for not more than 30 days, or both, at the discretion of a Magisterial District Judge, together with the costs of prosecution in each case.
B. 
All prosecutions for violations of this article shall be by summary proceedings brought in the name and for the use of the Borough of Jenkintown before the Magisterial District Judge of said Borough.
C. 
All fines and penalties shall be paid to the Borough of Jenkintown to apply to general funds.
