Any person who shall operate a motor vehicle or tractor upon any highway or portion thereof hereby established as a one-way highway, other than in the direction hereby established for traffic thereon, shall, upon conviction thereof, be sentenced to pay a fine of not more than $10 and costs of prosecution, and, in default of payment of such fine and costs, to undergo imprisonment for not more than five days.
A.

Any person who shall violate any provision of this section shall, upon conviction thereof, be sentenced to pay a fine of not more than $10 and costs of prosecution, and, in default of payment of such fine and costs, to undergo imprisonment for not more than five days.

A. 
Four-way stop intersections.
(1) 
There shall be four-way stop signs erected at the following intersections, and the appropriate officers and employees of the Borough of Lake City are authorized and directed to erect said four stop signs so that one sign controls traffic entering from each of the four entrances into said intersections.

A. 
Title. This section shall be known as the "Engine Brake Retarder Ordinance" (the "Ordinance") of the Borough of Lake City, Erie County, Pennsylvania (the "Borough").
B. 
Authority. This section is enacted pursuant the policy established by the Commonwealth of Pennsylvania Department of Transportation regarding engine brake retarder prohibitions. Pursuant to 67 Pa. Code § 179.10(20), the Borough requested an investigation and approval of the proposed prohibition, and the Department of Transportation granted its approval of the prohibition.
C. 
Findings. The Council of the Borough of Lake City of Erie County, Pennsylvania, finds as fact that the operation of a brake retarder on a motor vehicle so as to create excessive noise through the use of said brake retarder adversely affects the public health, safety and welfare of the residents of the Borough, and is therefore a nuisance in fact.
D. 
Prohibited acts.
(1) 
No person shall use or operate a brake retarder on any vehicle traveling on Pennsylvania State Route 18 ("PA 18"), northbound from the Borough line on Rice Avenue to the intersection with Pennsylvania State Route 5 ("PA 5") on Lake Street.
(2) 
It shall be unlawful to use or allow the operation of a brake retarder on a motor vehicle on that section of PA 18 as set forth above.
E. 
Emergency situations.
(1) 
This section shall not apply to emergency vehicles required or authorized to have brake retarders when responding to emergency calls.
(2) 
This section shall not apply to emergency driving situations requiring the utilization of an engine brake to protect the safety and property of the residents of the Borough, other motor vehicle operators, pedestrians, and the operator and passengers of the motor vehicle involved in said emergency situations.
F. 
Signage. Signs shall be posted in appropriate places advising motor vehicle operators of the prohibition against the use of engine retarding devices consistent with this section.
G. 
Penalty. Any person, persons, firm, corporation, association, organization or entity who or which violate any of the provisions of this section, upon summary conviction, shall be sentenced to pay a fine of not less than $100 and not more than $300, reasonable attorney's fees incurred by the Borough, plus costs of prosecution, and, in default of the payment thereof, be sentenced to undergo imprisonment as allowed by law for the punishment of a summary offense.
H. 
Enforcement. The provisions of this section shall be enforced by the Lake City Borough Police Department.
