All spray irrigation and stream discharge type sewage disposal systems hereafter installed within the Township of Lower Frederick, Montgomery County, Pennsylvania, shall conform to the following rules and regulations, which shall govern their design, installation, maintenance and removal, in addition to those regulations now in effect, and hereafter adopted by the following agencies:
A. 
Pennsylvania Department of Environmental Protection;
B. 
Pennsylvania Soil Conservation Service;
C. 
Montgomery County Board of Health; and
D. 
All other federal, state and governmental agencies having jurisdiction over such installations.
Prior to the installation of any spray irrigation or stream discharge system within Lower Frederick Township, a permit from the Township shall be required for such installation. This permit shall be in addition to all permits required from the DEP, EPA or the Board of Health, if any.
The following information shall be submitted to Lower Frederick Township so that a "determination of eligibility" may take place:
A. 
Completed 537 revision form;
B. 
Project description;
C. 
Construction plan; and
D. 
Reviewed by licensed engineer.
An application fee as set from time to time by resolution of the Board of Supervisors shall be submitted along with the information required in § 123-40. No review may begin until such time that this fee has been paid.

A. 
The proposal for the spray irrigation or stream discharge system shall be reviewed as follows:
(1) 
Lower Frederick Township Sewage Enforcement Officer;
(2) 
Lower Frederick Township Zoning Officer;
(3) 
Lower Frederick Township Engineer;
(4) 
Lower Frederick Township Planning Commission;
(5) 
Montgomery County Planning Commission;
(6) 
Montgomery County Department of Health; and
(7) 
Pennsylvania Department of Environmental Protection.
B. 
The above agencies and officials shall review the proposal for installation to determine compatibility with the intent and requirements of the following documents:
(1) 
Lower Frederick Township Comprehensive Plan;
(2) 
Chapter 145, Subdivision and Land Development, of the Lower Frederick Township Code;
(3) 
Chapter 170, Zoning, of the Lower Frederick Township Code;
(4) 
Lower Frederick Township Official Sewerage Facilities Plan; and
(5) 
Building-plumbing codes as set forth in BOCA.[1]

C. 
These agencies and officials shall report their findings to the Board of Supervisors.
A. 
In addition to the aforementioned documents, the spray irrigation and stream discharge system permit issuance will be considered subject to the following:
(1) 
Proximity to watershed areas, reservoirs and dams;
(2) 
Proximity to residential development and park lands;
(3) 
Availability of future public sewer connection; and
(4) 
Public safety and welfare.
B. 
In granting a spray irrigation stream discharge permit, the Board of Supervisors reserves the right to require certain improvements to the proposed site, in addition to those required by the county or state agencies, including but not limited to the regulations and requirements of § 123-44.
A. 
All spray irrigation and stream discharge systems installed within Lower Frederick Township shall be subject to a written agreement between the authorized officials of Lower Frederick Township and the property owner.
B. 
This agreement shall determine the conditions of the system installation, including but not limited to the following items:
(1) 
Location of system.
(2) 
Size of system.
(3) 
Type of system.
(4) 
Alarm hook-up to system.
(5) 
Fencing type and size, if any.
(6) 
Connection to building.
(7) 
Connection to spray system.
(8) 
Method of disconnection and disposal/removal of system (in the event of public sewer availability).
(9) 
Amount of escrow required, if any.
(10) 
Maintenance and testing requirements, ultimate sludge disposal.
No permit shall be issued by Lower Frederick Township until such time the following requirements have been met:
A. 
Application fee paid;
B. 
Written agreement approved by Board of Supervisors and executed by both parties;
C. 
Escrows paid;
D. 
Permit from Montgomery County Board of Health and DEP forwarded to Lower Frederick Township.
E. 
Permit fee paid.
A. 
The applicant shall give no less than three days' notice to Lower Frederick Township prior to beginning installation.
B. 
All system installations are to be in conformance with the rules and regulations adopted as part of the spray irrigation resolution. Lower Frederick Township reserves the right to suspend installation at any time by way of verbal and/or written notification should the tank installation at any time be in violation of the spray irrigation and stream discharge resolution, state, county or local regulations, including the building code, plumbing code or holding tank agreement.
C. 
No construction may begin or restart until such time written approval is given by the Lower Frederick Township Building Official.
All removal and/or disposal of the system shall be in compliance with the written agreement, and shall require notice to the Lower Frederick Township Administrative Office no less than 15 days prior to the start of removal or disposal.
Permits are nontransferable. The owner/permittee of each spray irrigation and stream discharge system shall agree to maintain and be responsible for the system subject to the terms and conditions stated in the previous sections, until such time a new agreement and escrow has been established between the next property owner and Lower Frederick Township.
The Board of Supervisors of Lower Frederick Township reserves the right to amend these regulations from time to time as deemed necessary.
