A building or structure may be erected or used and a lot may be used or occupied for any of the following uses and no other. All uses permitted by right or by special exception are subject to the specific regulations in Article XV for individual uses, in addition to the requirements contained in this and other sections.
A. 
Uses by right shall be as follows:
(1) 
Single-family detached dwellings.
(2) 
Retail uses specifically listed as follows: hand craft or specialty shops, art or framing gallery, photographer, artist of stained glass, artisan studio, dressmaker, milliner, tailor, leather workshop, iron work shop, basket shop, tinsmith, ceramic or pottery shop, shoemaker, jeweler, gem work, needle craft shop, fabric shop, candle maker, blacksmith, lamp shade shop, doll hospital, glass blower, lace maker, clock repair shop, toy shop, hobby shop, cabinet maker shop, woodwork shop, printer shop, paint store, locksmith shop, cosmetic shop, antique shop, candy shop, spice store, bakery shop, riding apparel and equipment shop, upholstery shop, furniture refinishing shop, television repair shop, video shop, museum/library.
(3) 
The office uses specifically listed as follows: government, real estate broker, stock or bond broker, paper broker, food broker, commodity broker, physician, chiropractor, dentist, optician, psychologist, podiatrist, veterinarian, lawyer, accountant, investment counselor/advisor, architect, child guidance counselor, wedding consultant, estate planner, career counselor, surveyor, advertising and direct mail, telephone answering service, banking and saving and loan, and engineering, employment, travel, insurance or ticket office.
(4) 
The teaching of cooking or crafts.
(5) 
A restaurant.
(6) 
A residence in combination with a permitted commercial use is permitted provided that the following special regulations shall also apply:
(a) 
A maximum of two dwelling units in combination with a single commercial use per structure shall be allowed.
(b) 
All residential uses shall contain full kitchen and bath facilities within the individual unit.
(c) 
A private yard of at least 200 square feet shall be designated on site for each dwelling unit.

(d) 
The dwelling unit access shall be separate from that of the commercial.
(e) 
Off-street parking spaces as required for both the commercial and residential uses shall be provided.
(7) 
Uses and structures accessory to permitted uses.
(8) 
Forestry/timber harvesting, pursuant to the regulations set forth in Article XV, § 200-68.

B. 
Conditional uses.
(1) 
Uses other than those set forth above may be permitted in the H-C District by the Board of Supervisors as a conditional use. Conditional use approval may be granted provided that the use for which such approval is sought complies with all of the following standards:
(a) 
Such use shall be of the same general nature as those permitted as of right.
(b) 
Such use shall be of the same general nature and character as were the uses in the original village.
(c) 
Such use is in accordance with the spirit, purpose and intent of the Historical Commercial District.
(d) 
Such use conforms with all of the other applicable requirements of the Historical Commercial District and of this chapter in general.
(e) 
The conditional use standards of Article XXII of this chapter.[1]

C. 
Prohibited uses. The following uses shall not be permitted in the HC District:

(1) 
Any use with a drive-through service.
(2) 
Convenience store.
(3) 
Gasoline station or motor vehicle service station or similar facility.
(4) 
Fire station.
(5) 
Large retail store or garden mart.
A. 
Area requirements. Area requirements shall be as follows:
(1) 
Minimum net lot area: 10,000 square feet.
(2) 
Minimum lot width at front building line: 75 feet.
(3) 
Maximum building coverage: 40%.
(4) 
Maximum impervious surface ratio: 80%. Underground stormwater management or porous pavement shall be used.

(5) 
Maximum height: 35 feet.
B. 
Setback requirements for buildings at the boundaries of the H-C District:
(1) 
Thirty feet from the boundaries of the district.
(2) 
Thirty feet from the center line of Edgewood, Yardley-Langhorne and Stony Hill Roads, or five feet from the right-of-way of the same street, whichever is more restrictive.
C. 
Setback requirements for buildings on any individual lot.
(1) 
Front. Twenty-five feet front yard setback, unless lot abuts Edgewood, Yardley-Langhorne or Stony Hill Roads, in which case the front yard shall be 30 feet from the center line of Edgewood, Yardley-Langhorne and Stony Hill Roads or five feet from the right-of-way of the same street, whichever is more restrictive.
(2) 
Side. Fifteen feet side yard setback, or a combination of two side yard setbacks as follows: five feet and 25 feet or 10 feet and 20 feet.
(3) 
Rear. Fifteen feet rear yard setback.
(4) 
For structures to be rehabilitated, no portions shall be closer to the road than as originally constructed and all additions or extensions to primary or principal structures shall occur behind the front building line and shall not project closer than 15 feet to a side lot line nor 15 feet to a rear lot line.
(5) 
Accessory structures shall be located behind the front building line of the primary structure or the front building setback line, whichever is greater. Detached garages and accessory garage structures may be within 2 1/2 feet of the side and rear property line.

Structures or uses may be erected, altered, enlarged or maintained only if they comply with the following requirements:
A. 
The Historical and Architectural Review Board reviews such action in accordance with the provisions of its bylaws and standards, as defined in Appendix B, Historic District,[1] of the Township of Lower Makefield Zoning Ordinance, the ordinance herein,[2] and a Certificate of Appropriateness, as provided by that review, has been issued by the Lower Makefield Township Board of Supervisors.

B. 
Each commercial use shall be conducted wholly within an enclosed building.
C. 
There shall be no manufacturing or processing except that which is incidental and essential to a permitted commercial use.
D. 
No required yard shall be used for the storage of vehicles, equipment, containers or waste materials. The display, sale or storage of merchandise, however, may be permitted in the required yards provided that such display, sale or storage is temporary in nature and is removed during hours in which the business is closed to the public.
E. 
Overall plan required. Each proposed H-C District development shall be constructed in accordance with an overall plan, which shall be designed as a single architectural scheme with appropriate landscaping and shall be subject to the land development requirements contained in this chapter.
F. 
Buffers shall be required at the boundaries of the H-C District in accordance with Article XVI, Buffers, of this chapter. All trash storage, receptacles or drying yards shall be completely screened from view from all surrounding properties, residential or nonresidential.
