As used in this chapter, the following terms shall have the meanings indicated unless a different meaning appears from the text:
MINOR
A person under the age of 18 years.
PARENT
Any natural parent of a minor as herein defined or a guardian or any adult person responsible for the care and custody of a minor. When used in this chapter, "parent" shall mean one or both parents.
PUBLIC PLACE
Any public street, alley, sidewalk, park, playground, public building, or vacant lot in the Township of Middlesex, Butler County, Pennsylvania.
This chapter prescribes, in accordance with prevailing community standards, regulations for the conduct of all minor(s) on streets at night for the protection of younger children in the Township of Middlesex, from each other and from other persons on the streets during nighttime hours; for the enforcement of parental control and responsibility for their children; for the protection of the public from nocturnal mischief by all minor(s); and for the reduction of the incident of juvenile criminal activity, for the good of minor(s) and for the public good, safety and welfare.
A. 
It shall be unlawful for any minor to be in or remain in or upon any public place within the Township of Middlesex, Butler County, Pennsylvania, or in any enclosure or vehicle which is on or in close proximity to any such public place, between the hours of 11:00 p.m. and 6:00 a.m. on the following day, except as follows:
(1) 
A minor when accompanied by a parent or guardian having legal custody of such minor.
(2) 
A minor lawfully employed en route to or returning from their place of employment.
(3) 
A minor who is a member of a volunteer fire company who is en route to or returning from emergency duties as permitted by fire company regulations.
(4) 
A minor going to or returning home from a church, school or community sponsored function which they attended and for which they possess a signed written statement by their parent dated that day which refers to the event and the time that the minor shall be going to or returning from the event.
B. 
No exceptions under this section shall apply to any minor under the provisions of Subsection A(2), (3), and (4) unless said minor shall go to or return from their place of residence and the event excepted by the most direct route.
It shall be unlawful for a parent to allow any minor to violate the restrictions set forth in § 68-3.
Any person who violates or permits a violation of this chapter shall, upon conviction in a summary proceeding brought before a District Justice under the Pennsylvania Rules of Criminal Procedure, be guilty of a summary offense and shall be punishable by a fine of not more than $1,000, plus costs of prosecution. In default of payment thereof, the defendant may be sentenced to imprisonment for a term not exceeding 90 days. Each day or portion thereof that such violation continues or is permitted to continue shall constitute a separate offense, and each section of this chapter that is violated shall also constitute a separate offense.
