A certain document, three copies of which are on file in the office of the Township of Concord, being marked and designated as the "International Fire Code, 2003 Edition," as published by the International Code Council, Inc., is hereby adopted as the fire prevention code of the Township of Concord for the control of buildings and structures as herein provided; and each and all of the regulations, provisions, penalties, conditions and terms of the International Fire Code, 2003 Edition, Chapters 1 through 45, inclusive, and Appendixes B, D, E, F and G, are hereby referred to, adopted and made a part hereof, as if fully set out in this article, with the additions, insertions, deletions, and changes, if any, transcribed in § 112-2 of this article.
The following provisions of the 2003 Edition of the International Fire Code are hereby revised to read as follows:
A. 
Chapter 1, Section 101, GENERAL, Paragraph 101.1, Title.
101.1 Title. These regulations shall be known as the "Fire Code of Concord Township," herein after referred to as "this Code."
B. 
Chapter 1, Section 104, GENERAL AUTHORITY AND RESPONSIBILITIES, Paragraph 104.1, Enforcement officer.
104.1. Enforcement Officer.
It shall be the duty and responsibility of the Fire Marshal and the Deputy Fire Marshal to enforce the provisions of the fire prevention code as herein set forth. The designated enforcement officer of this code is herein referred to as the "Fire Code Official."
The Supervisors of Concord Township, from time to time by resolution, shall appoint a Fire Marshal and a Deputy Fire Marshal, prescribe their duties and responsibilities, and fix their compensation.
The duly appointed Fire Code Officials are hereby authorized to enforce the provisions of this code and shall have the authority to render interpretations of this code, and to adopt policies, procedures, rules and regulations in order to clarify the application of its provisions. Such interpretations, policies, procedures, rules and regulations shall be in compliance with the intent and purpose of this code and shall not have the effect of waving any requirements specifically provided for in this code.
C. 
Chapter 1, Section 109, Paragraph 109.3, Violation penalties.
109.3 Violation penalties. Persons who shall violate a provision of this code or shall fail to comply with any of the requirements thereof or who shall erect, install, alter, repair or do work in violation of the approved construction documents or directive of the Fire Code Official, or of a permit or certificate used under provisions of this code, shall be guilty of a summary offense punishable by a fine of not more than $1,000 or imprisonment not to exceed 30 days, or both such fine and imprisonment. Each day that a violation continues after due notice has been served shall be deemed a separate offense.
D. 
Chapter 9, FIRE PROTECTION SYSTEMS, Section 903, AUTOMATIC SPRINKLER SYSTEMS.
903.2 Where required.
Approved automatic sprinkler systems in new buildings and structures shall be provided in the locations described in this section and in Use Group B Business Use where the fire area exceeds 12,000 square feet (1115M2).
Exception: Spaces or areas in telecommunications buildings used exclusively for telecommunications equipment, associated electrical power distribution equipment, batteries and standby engines, provided those spaces or areas are equipped with an automatic fire alarm system and are separated from the remainder of the building by a wall with a fire-resistance rating of not less than one hour and floor/ceiling assembly with a fire-resistance rating of not less than two hours.
E. 
Appendix B, FIRE-FLOW REQUIREMENTS FOR BUILDINGS, Section B103, MODIFICATIONS, Paragraph B103.1, Decreases.
B103.1 Decreases. The Fire Code Official is authorized to reduce the fire-flow requirements for isolated buildings or a group of buildings in rural areas or small communities where the development of full fire-flow requirements is impractical.
F. 
Appendix B, FIRE-FLOW REQUIREMENTS FOR BUILDINGS, Section B103, MODIFICATIONS, Paragraph B103.2, Increases.
B103.2 Increases. The Fire Code Official is authorized to increase the fire-flow requirements where conditions indicate an unusual susceptibility to group fires or conflagrations. An increase shall not be more than twice that required for the building under consideration.
That nothing in this article or in the Fire Prevention Code hereby adopted shall be construed to affect any suit or proceeding pending in any court, or any rights acquired or liability incurred, or any cause or causes of action acquired or existing, under any act or ordinances hereby repealed as cited in § 112-4 of this article; nor shall any just or legal right or remedy of any character be lost, impaired or affect by this article.
All ordinances or parts of ordinances inconsistent herewith, and especially Ordinance No. 196, adopted October 4, 1994, are hereby repealed to the extent of such inconsistency.
