Whenever an emergency exists by reason of riots or disturbances or disorderly assemblage or to preserve the public peace and order, the Mayor, as chief executive officer of the borough, or the Acting Mayor of the borough may, by the authority vested in him by law, issue a proclamation setting forth the reasons for such proclamation and such rules and regulations as he may deem necessary and advisable in order to restore peace and good order.
The Mayor or Acting Mayor shall have power to impose, by the proclamation provided for in § 37-1, any or all of the following regulations:
A. 
To impose a curfew upon all or any portion of the borough, thereby requiring all persons in such designated curfew areas to forthwith remove themselves from the public streets, alleys, parks or other public places, provided that physicians, nurses and ambulance operators performing medical services, utility personnel maintaining essential public services, firemen and borough-authorized or -requested law enforcement officers and personnel may be exempted from such curfew.
B. 
To designate any public street, thoroughfare or vehicle parking area closed to motor vehicles and pedestrian traffic.
C. 
To order the closing of any business establishments anywhere within the borough for the period of the emergency, such businesses to include but not be limited to those selling intoxicating liquors, cereal, malt beverages, gasoline or firearms.
D. 
To order the discontinuance of selling, distributing or giving away gasoline or other liquid flammable or combustible products in any container other than a gasoline tank properly affixed to a motor vehicle.
E. 
To order the discontinuance of selling, distributing, dispensing or giving away of any firearms or ammunition of any character whatsoever or the display thereof.
F. 
To call upon regular and auxiliary law enforcement agencies and organizations within or without the borough to assist in preserving and keeping the peace within the borough.
G. 
To issue such other orders as are imminently necessary for the protection of life and property.
H. 
Provided that it shall be determined that a safety problem exists for ingress and egress to any public or private school or for the provision of recreational facilities for children attending such school or both, due to lack of a suitable area surrounding the school, to close any portion of any public street within the block, upon which such school is located, to the use of through traffic during such time as shall be deemed necessary to provide for the safety of the school children, not to exceed one hour between 7:30 a.m. and 10:00 a.m. and two hours between 11:00 a.m. and 2:00 p.m. and one hour between 2:30 p.m. and 4:30 p.m. on any days upon which such school is in session, and to permit the use of said portion of said street during said hours for ingress and egress to such school and for the use by the pupils of such school for recreational purposes under proper supervision, provided, further, that proper warning signs shall be erected and maintained for said purpose.

Upon filing of the proclamation provided for in § 37-1 with the Borough Clerk, the same shall become effective, having the force of law, and shall remain in full force and effect until the above proclamation has been terminated by filing a copy of such termination with the Clerk by the Mayor or Acting Mayor; provided, however, that in the event no termination notice is so filed within six months of the date of said proclamation, the same shall be terminated by law.
