This article provides for the protection of children through official state licensing requirements for child-care centers and nursery schools and the voluntary registration of family day-care providers.
CERTIFICATE OF REGISTRATION — A document issued by a sponsoring organization to a family day-care provider, acknowledging that the provider is in compliance with all applicable provisions of this chapter.
CHILD
Any person under 14 years of age.
COOPERATIVE AGREEMENT
An agreement between a provider and a parent to exchange child-care services in lieu of a fee for child-care services.
DENIAL OF A CERTIFICATE OF REGISTRATION
A refusal by the sponsoring organization to issue an initial certificate of registration.
EVALUATE
The review of a family day-care provider by a sponsoring organization upon receipt of an application for a certificate of registration to determine the applicant's compliance with the requirements of this chapter.
FAMILY-DAY CARE HOME
A private residence in which child-care services are provided for a fee of no fewer than three and no more than five children for no fewer than 15 hours per week, except that the Division shall not exclude a family day-care home with fewer than three children from voluntary registration.
FAMILY DAY-CARE APPLICANT
A person at least 18 years of age who has applied for a certificate of registration.
FAMILY DAY-CARE PROVIDER
A person who has received an initial, renewal or temporary certificate of registration issued by a sponsoring organization.
FAMILY DAY-CARE SPONSORING ORGANIZATION
An agency or organization that contracts with the Division to assist in the voluntary registration of family day-care providers and that complies with all applicable requirements of the Manual of Requirements for Family Day-Care Registration.
MANUAL OF REQUIREMENTS
The requirements contained in this chapter (N.J.A.C. 10:126).
MONITOR
To visit a registered family day-care provider to review the provider's compliance with the applicable requirements of the Manual of Requirements.
NURSERY SCHOOL
Any place where one or more children under the age of six years are cared for, unattended by a parent or legal guardian, for periods less than one day. This shall not include care by any person related by blood or marriage.
PARENT
A natural, foster or adoptive parent, guardian or any person with responsibility for or custody of a child.
PROVIDER ASSISTANT
A person at least 14 years of age who has been designated by the provider and approved by the sponsoring organization to assist the provider in caring for children in the home.
REFUSAL TO RENEW A CERTIFICATE OF REGISTRATION
The nonissuance of a certificate of registration by the sponsoring organization after the expiration of the existing certificate of registration.
REVOCATION OF CERTIFICATE OF REGISTRATION
A permanent removal of a provider's current certificate of registration for failure to comply with the applicable requirements of the Manual of Requirements.
SUSPENSION OF CERTIFICATE OF REGISTRATION
A temporary removal of a provider's current certificate of registration, which can be reinstated by the sponsoring organization upon the provider's compliance with the applicable requirements of the Manual of Requirements.

Any building occupied as a child-care facility shall:
A. 
Have potable water at sufficient pressure and quantity required for its needs.
B. 
Have lavatories and flush toilets in sufficient number as may be required.
C. 
Have facilities for the discharge of all soil and liquid waste into an approved sewerage system.
D. 
Have adequate heating facilities maintained so that sufficient heat is available when necessary and be vented so that all possible hazards shall be safeguarded.
E. 
Have standard first-aid equipment as approved by the Board of Health and kept accessible at all times.
F. 
Be provided and accommodated and be in all respects in that condition of cleanliness and wholesomeness required by this chapter or any other applicable law of the state.
The following rules and regulations shall govern the establishment, maintenance and operation of nursery schools for infants and children:
A. 
Nursery schools shall be operated during the period of the permit and on weekdays only between the hours of 7:00 a.m. and 7:00 pm. The school shall be open to inspections during the operational hours,
B. 
At no time shall more infants or children be kept in a nursery school than can be well and sufficiently cared for.
C. 
The person to whom a state license is granted to operate a nursery school must have had training and experience adequate for such purpose and must give personal supervision to the care and hygiene of the child or children entrusted for care.
D. 
The licensee and all employees shall, at the beginning of the school year and as often thereafter as the inspector may deem necessary, submit a physician's certificate of health stating that he or she is free from any communicable disease.
E. 
No person who is affected with any disease in a communicable form, or is a carrier of such disease, shall work in any nursery school, and no licensee shall employ any such person or any person suspected of being affected with any disease in a communicable form, or being a carrier of such disease. If the licensee suspects that any employee contracted any disease in a communicable form, or has been a carrier of such disease, he shall notify the inspector immediately.
F. 
The licensee shall maintain all equipment in a safe condition.
G. 
Each building and adjacent ground used as a nursery school shall be inspected and must be approved by the inspector, the Fire Department and the Building Department of the municipality as being safe and sanitary.
H. 
Rooms below ground level must not be used unless approved by the inspector, Fire Department and Building Department of the municipality as being safe and sanitary.
I. 
The windows and doors of all buildings used as a nursery school shall be provided with screens from May 1 to November 1.
J. 
Adequate heating shall be maintained within the building. Open fires or oil heaters and all other possible hazards shall be safeguarded.
K. 
Adequate toilet facilities shall be provided. Each toilet and toilet room shall be kept clean.
L. 
Adequate facilities for washing hands, including clean water, soap and clean paper or single-use linen towels, shall be provided at a place convenient for use.
M. 
Standard first-aid equipment as approved by the inspector shall be provided and kept accessible at all times.
N. 
Emergency phone numbers and emergency exits shall be posted appropriately.
O. 
Outdoor play space must be well drained, enclosed and free from injurious substances.
P. 
No common drinking cup shall be furnished or kept accessible to the water supply. Individual paper cups or spray fountain of a type approved by the Board of Health shall be used exclusively.
Q. 
Children shall be observed at all times for signs of illness, and if showing, shall be promptly isolated, entirely apart from other children, and sent home as soon as possible.
R. 
In nursery schools where children under two years of age are accepted for care, a supply of clean diapers shall always be available.
S. 
Nursery schools that serve snacks or meals shall comply with Chapter XII of the State Sanitary Code.
T. 
Proper records shall be kept for each child in attendance including the name, sex, age and current address. A current vaccination record, emergency contact numbers and permission slips for field trips shall also be kept.
A. 
Applicability. The following regulations apply to all pupils.
B. 
Responsibilities. The principal, director or other person in charge of a school shall be responsible for adherence to the regulations noted in this article.
C. 
Regulations. For the purpose of this article, and pursuant to adhering to state standards, Chapter XIV of the State Sanitary Code (N.J.A.C. 8:57 et al and as amended, which is subsequent to N.J.S.A. 26:4) shall be utilized as the regulations to be followed by this article.
Child-care centers shall be licensed and operated in accordance with N.J.A.C. 10:122, as amended.
Family day-care centers shall be licensed and operated in accordance with N.J.A.C. 10:126.
No person shall conduct or maintain any nursery and day school for infants or children within the Borough without first having obtained a permit therefor from the Board of Health. Fees for such permits shall be charged as set forth in Article II of these sanitary standards.
The New Providence Board of Health permit shall in no way preempt, replace or conflict with licenses or permits required by other enforcement agencies. The operator shall cooperate with all requirements of the State of New Jersey, Division of Youth and Family Services.
