This article establishes a code to deal with public recreational bathing places such as swimming pools, hot tubs, spas and the like. It addresses various construction, safety, maintenance standards and procedures. It also addresses various fees and permits.
A. 
The Board of Health hereby adopts by reference, as though set forth at length herein, the provisions of standards of public recreational bathing found at N.J.A.C. 8:26-1 et seq., as may be amended thereafter.
B. 
The following requirements also apply.
No person shall operate a public recreational bathing facility until a license is received from the Board of Health as prescribed in Article II, Permits and Chapter 337, Swimming Pools, Public.
A. 
Licenses issued for the operation of a public recreational bathing facility shall expire annually on December 31 and an application for renewal shall be submitted, together with the required fee, prior to the opening of the facility for the season.
A. 
A license required by this article may be denied or suspended by the Board for failure to comply with this article.
B. 
The Board of Health shall afford the person whose license to operate has been denied or suspended an opportunity to be heard in public hearing and to be informed of the Board's decision.
C. 
Revocation of license. Failure to maintain the sanitary quality within the time directed by the Board of Health to abate a violation of this article shall be sufficient cause for revocation of license.
No person having skin lesions, sore or inflamed eyes, mouth, nose or ear discharge or who is a carrier shall knowingly use any public recreational bathing place or be permitted to use any public recreational bathing place.
No person shall discharge of wastewater into the municipal sanitary sewage system without written permission of the municipal sewage authority. A pool shall be discharged in accordance with the New Jersey Department of Environmental Protection standards.
A. 
The municipal plumbing inspector, building and zoning officers and fire inspectors may inspect any public recreational bathing place for compliance with the applicable codes. Any violations may be subject to the enforcement procedures of these respective codes.
B. 
The owner or operator of any public recreational bathing place within the municipality shall allow the inspector access to any public recreational bathing place and appurtenances for the purpose of inspection to ascertain compliance with this article at all times of normal operation.
Any person in violation of this article or the public recreational bathing regulations, or any other applicable laws, may be subject to the penalties provided in Article III of this chapter.
