No person shall keep domestic, wild or exotic animals as pets within
the municipality except as provided by the following. "Exotic animal" shall
mean any nongame species that is not indigenous to New Jersey.
No person may keep more than four adult dogs or cats in total as pets
within the limits of the municipality. Every dog and cat harbored in the municipality
must obtain a yearly license from the Borough Clerk's office.
A.
No livestock, wild or exotic animals shall be permitted
or kept within the limits of the municipality without first obtaining a permit
from the Board of Health by presenting a statement with an application for
the permit. Said permit shall be issued by the Board of Health for one year
for a fee of $25.
B.
The following information must be submitted to the Board
of Health:
(1)
The consistency and acceptability to local zoning regulations
regarding property use.
(2)
The kind and number of animals or fowl the permit is
to cover.
(3)
Proof that each animal has been appropriately vaccinated.
(4)
The location of the premises where such animal or fowl
will be kept.
(5)
Plot plan of the premises and structures provided for
the care and maintenance of the animals or fowl.
(6)
A list and plan of all abutting properties and those
within 250 feet by type and relationship to that of the applicant.
(7)
A plan for containment of fecal matter and food, water
supply and methods of waste control and disposal.
(8)
A signed statement by the applicant acknowledging the
permit may be revoked or the animals or fowl removed, through termination
of the permit at any time for good cause by the Board of Health, if a public
health nuisance, as declared by the Board of Health, is caused by said animals
or fowl.
(9)
A complete statement of plan and intent, as set forth
in the application presented by the applicant to the owners of all abutting
properties and those within 250 feet. The owners of abutting properties must
be given notice and an opportunity to declare their objection to the issuance
of a permit at a public meeting scheduled by the Board of Health.
(10)
The holder of a permit shall comply with all state, county
and local laws, ordinances and regulations.
(11)
A copy of the required New Jersey Department of Environmental
Protection permit for wild and exotic animals where applicable.
(12)
Any such other information as the Board of Health may
require.
Every animal keeper shall be subject to the conditions of the municipal
noise ordinance with respect to their animals.
A.
No animal keeper shall permit their animal(s) or fowl
to run at large in the municipality.
B.
Impounding of dogs running at large. Whenever a dog is
found running at large, it shall be the duty of an authorized agent to take
such animal into custody.
C.
Leash required. No person owning, possessing, keeping,
harboring or in charge of a dog shall allow or permit such dog to be at any
public place, on any sidewalk or any public property except when held on a
leash by a person capable of controlling the dog, or on any private property
without permission of the owner or occupant thereof.
D.
Any additional costs, including administrative costs,
incurred by the Borough for the purpose of impounding strays will be charged
to the owner of the dog.
No person shall keep pets in any building or premises in the municipality
where the Board may deem the keeping detrimental to the public's health.
A.
When conditions warrant the issuance of an order to stop
the keeping of pets at a particular location, the order shall be in writing
and posted on the premises. The owner or person in charge of the animals shall
remove or cause them to be removed within the time provided. Where immediate
removal is essential, the Health Officer or Registered Environmental Health
Specialist may require immediate removal without an order.
B.
If the order is not complied with, the Health Officer
or Registered Environmental Health Specialist shall arrange for the removal,
maintenance or destruction of the offending animals an appropriate manner.
C.
The cost of such removal, maintenance or destruction
shall be paid for by the animal owner or responsible person.
The owner or person in charge of any animal that dies shall dispose
of the carcass within 24 hours in a manner not detrimental to the health and
well being of the municipality.
A.
No person owning, keeping, harboring or having the ability
to prevent any dog or other animal shall knowingly or negligently allow any
dog or other animal to commit any nuisance or to soil, urinate on, defecate
on or defile any public street, avenue, lawn, park or public building, plaza,
store or upon any place of public passage or congregation whatsoever or upon
any private property within the Borough of New Providence, nor shall any such
person refuse to take reasonable and proper action to prevent any dog or other
animal from committing said nuisance or act upon any location specified or
indicated within this article.
B.
Restrictions under this article shall not apply to the
space between curblines but be applicable under the following conditions:
(1)
The person who commits or curbs such animal shall immediately
remove all feces deposited by such animal by any proper sanitary method or
instrument approved by the New Providence Board of Health.
(2)
The feces so removed shall be disposed of by the person
in charge of the animal so curbed in a sanitary manner as approved by the
Board of Health.
C.
Any owner of keeper who requires the use of a disability assistance
animal shall be exempt from the provisions of this section while such animal
is being used for that purpose.

Any person violating the provisions of this article, upon conviction,
shall be subject to the imposition of penalties as provided, pursuant to Article
III hereof.
